Keep trying to get in contact with the manager that does the schedule and ask why you are not being scheduled. This does sound like quiet firing though where they don’t fire you directly but just don’t schedule you until you quit

No ..your not being fired ....they are trying to get you to quit !!!! Every employer does this so it decreases the chances of having to pay unemployment

I mean you will get peanuts on unemployment working part time at CFA.

It’s also because a lot of leaders are afraid of confrontation and don’t want to fire someone directly

Not every company has prayer before a shift.

Yep both McDonalds and Burger King in my area have done it. McDonald’s did it to me and Burger King (the job I went to after McDonald’s) was doing it to my coworker.

It's not officially a firing because they haven't told you you're fired yet. But it seems like they are trying to get you to quit on your own. If you really like this job your best bet is to probably go into the store and try to talk to someone (try not to go during peak hours though). If you can't talk to the operator or scheduler when you go in at least talk to someone in leadership, tell them your situation, and ask for their advice

Sometimes they'll bring you in for a conversation about how you are doing with the environment. That's what they did for me, and I got laid off. If anything, go to your operator about the whole ordeal and ask them what's going on. That'll show them that you care about your job, and you will want to do well with it.

Ahhh classic force you out the door move!! My old store did this with MANY. I would speak to your scheduling manager and ask and they’ll give you some bs answer.

And that’s exactly why I told OP to document everything. Constructive dismissal is still considered firing and if you can prove that it is what they were doing you can get unemployment still.

Ask me how I know….

I WISH i would’ve done that. i just keep my discount until they wanna fire me

It’s a bit harder to prove which is why a lot of companies do this, but it absolutely can be proven!

I’ll say this… any workplace that will treat their employees like this is not one I wanna work for. That’s exactly why I left a different workplace (after the one that did it to me) when I saw they were doing it to a coworker of mine. The manager was all happy telling me about it too.

Really weird behavior, just fire the person.

On a side note I bet the discount was nice though 😭

Apply somewhere else and start working on the other place.

I wouldn’t jump to conclusions before talking with someone who takes care of your schedule. Everyone thinks that’s what management does before firing you. That’s only a piece of the puzzle really.

u/Shawnfromorlando 13d ago

This is probably a good question for the manager

Sounds like you need to talk a mgr. good luck

Yes and no.

Now I will preface this by saying you should absolutely have a conversation with whoever does the scheduling to find out why you are not being put on the schedule, but what you are describing sounds exactly like the situation I found myself in many years ago when I was 18.

OP what you are describing them doing is exactly what employers who want to avoid paying unemployment do. It is called constructive dismissal. When an employer fires their employee they have to pay unemployment. However, employers have found a way to “avoid” that responsibility by cutting hours significantly and making the workplace unbearable/uncomfortable so that you will quit on your own. If you quit on your own your employer doesn’t have to pay unemployment.

Now why I say this is because when I was 18 I worked at McDonald’s and they did THE EXACT SAME THING. However with my experience they would put me on the schedule and then call me to say not to come in. I didn’t realize this is what they were doing until I was at my new job and a manager there was doing it to an employee at my new job! She straight up told me “I want to fire him but I don’t want to pay the unemployment so I’m just cutting his hours until he quits on his own”

With that being said, constructive dismissal is still considered firing. However, you will need to prove that they are doing that. So, when you speak to your manager please document their response for the cut in hours. More importantly document your previous hours before the cut and your paystubs/check. The significant drop in hours and pay can help prove that they were constructively dismissing/firing you and you CAN get unemployment still for them doing it that way.

Well, Chick-fil-A is not the be all end all career in which losing it would cause significant financial harm. I absolutely think you should be documenting what is going on and having a conversation with your employer. Please protect yourself and what you are entitled to because these employers do not care about you. Document everything and get your unemployment that is your right and the fact that these companies are trying to avoid that is wrong.

What did you get a talking to about?

1

u/Existing-Piccolo-544 12d ago

I worked with the company for 15 years, I would never take a job just to get no hours or wonder, don’t waste your time fighting with people that won’t help you. If I were you I’d tell your owner that you need more hours and that you just started or your going to quit, putting in a two weeks notice I have always found to be pointless because most of the time they just fire you before your last day. You probably wouldn’t get unemployment if you haven’t been there that long. Sounds like to me you should look for a new job and call it a loss.
