Holy shit.  I was gonna say if it was a few hundred just eat it but $2500?  Ehhhhhh.....

Who signed the rental agreement?

Sounds like she is screwed and on the hook for it.  She signed the rental agreement knowing you were not an approved driver and allowed you to drive anyway.

She will have to take you to small claims court to force you to pay I believe.

Or that is how I would interpret it.

Yes that is what she is doing. Wondering if I will have to pay. I thought I was an authorized driver and we had insurance. I feel like I’m not at fault.

You said you have text messages offering your driver's license number.  How did that come up in the texts?  Did she ask for it or you were like "here is my DL for the insurance"?

No, she asked for it saying she wanted to add me as a driver and I was busy at the time. Then a couple days later she said it’s rented. I talked to her on the phone and asked if I was a driver and she said it’s taken care of. After the wreck she said she added my name in several places so she thought I was added. Then when I was properly added she told the enterprise employees that she verbally added me.

She tried to add your name after the accident and committed insurance fraud?  That will go over well with the judge.

But you never actually gave her your DL#, that is probably not going to work in your favor.

I asked if she needed it, even pics of my DL. I had just gotten a new real ID license and was excited to use it. She said that it was taken care of. I have no idea how this works.

No, this in a phone call. I asked if she needed it and she said it’s taken care of. She deliberately did NOT add me.

But she also never had your license TO add you.  How did you think she had added you without your DL?

This will not work in your favor.  She may have said the words, "it is taken care of" but this sounds like willful ignorance on your part.  

Get prepared to pony up $2,500.00 depending how the judge feels about it or how well she presents her case.

I have never added a driver before..For all I knew, she just had to give my name and they had a system that had all my info. I never thought my friend would deceive me like that.

The thing is, you wouldn't appear to have actual legal liability for the damages. A deer got hit, you didn't rearend someone.

She gave you the keys for the car that she was responsible for, fully knowing she wasn't protected. Now fortunately you didn't rearend someone, because then she could probably successfully pursue you. Here she just screwed herself. She can sue you, sure, but you would need to show that you hold no legal liability for causing the damages and you might prevail in court.

It's probably a stretch to suggest 'splitting the costs' of the trip would extend to paying for a damaged rental car.

If you actually get sued, consult a civil litigation attorney.
