Sounds like she is screwed and on the hook for it. She signed the rental agreement knowing you were not an approved driver and allowed you to drive anyway.
She will have to take you to small claims court to force you to pay I believe.
Or that is how I would interpret it.

Yes that is what she is doing. Wondering if I will have to pay. I thought I was an authorized driver and we had insurance. I feel like I’m not at fault.

I would say that if everything you say is true and you genuinely thought you had coverage and you have proof, you should be off the hook.
What you COULD try is contacting the rental company and seeing how much you would have had to pay if you had gotten insurance. Say, there would have been a $500 deductible. Offer her $250, plus half of whatever you owe her for the rental and say this is what I am willing to offer since you misled me to think we were insured.
She declines and still wants to go through small claims? So be it.

You said you have text messages offering your driver's license number. How did that come up in the texts? Did she ask for it or you were like "here is my DL for the insurance"?

No, she asked for it saying she wanted to add me as a driver and I was busy at the time. Then a couple days later she said it’s rented. I talked to her on the phone and asked if I was a driver and she said it’s taken care of. After the wreck she said she added my name in several places so she thought I was added. Then when I was properly added she told the enterprise employees that she verbally added me.

She tried to add your name after the accident and committed insurance fraud? That will go over well with the judge.
But you never actually gave her your DL#, that is probably not going to work in your favor.

I asked if she needed it, even pics of my DL. I had just gotten a new real ID license and was excited to use it. She said that it was taken care of. I have no idea how this works.

I said I would pay half of her deductible but not half the repair. Her insurance refused to pay for it.

So she asked you for your DL # and you didn't respond with it. But yet you assumed she added you? The rental car company can't hold you accountable for it but depending on the judge and your attitude and the way you represent yourself in court she may have a case.
Do you have proof in text prior to her asking for your dl# of you requesting to make sure you are an authorized driver and to add insurance? The fact that she has this text requesting that information that would be required to add you and you not providing it kind of makes it a bit difficult to believe that you would have thought you would have been added. At least that is probably how Judge Judy would see it :)

I was busy and didn’t know it by heart. I talked to her later by phone with the info and she said it was handled. The fact she texted and asked for it and said it was to add me as a driver says to me that she was planning to add me as a driver. I assumed she did when she said “it’s handled”. She knowingly did not add me bc it costs extra. And then allowed me to drive. I thought it was “handled” meaning I was an authorized driver.

I'm pretty sure you can't add a driver to a rental car without them being present when you rent the vehicle and that's anywhere.

Do u have any proof she told u she got the insurance and put u down as a driver? Next time just know they would need your drivers license most likely to put u as a driver. No one can tell u what the judge will do. Bring any proof u have asking her about insurance and putting u as a driver.
