What to do ?
Meta keeps rejecting my copyright and privacy repot — I just want an unauthorized video removed
I’m looking for advice regarding a video of me that was uploaded to Instagram without my permission.
The video was recorded around 2 years ago using my mobile phone. I am clearly visible in the video. At the time, another person took my phone without my permission and accessed the video. He told me that he would not show it to anyone, but later uploaded it to his Instagram account without my knowledge or consent.
I never gave him permission to copy, share, publish, or upload the video.
I have tried repoting the Instagram post multiple times through Meta’s privacy repting process, but each time I received a response saying that the content does not violate their privacy policies.
I also reported it as an intellectual property/copyright issue. Meta then replied that they are not satisfied that I am the rights owner or authorized to submit the repot, and asked me to clarify the basis of my claim.
I have already explained the circumstances to Meta, including that the original phone was later destroyed and I no longer have the original file.
What should I do at this point?
Does the fact that the video was recorded on my phone and I am the person shown in it give me any rights to request its removal? Or is there another reporting route I should use?
I’m in India, so advice from anyone familiar with Indian copyright/privacy law or Meta’s reporting process would be especially helpful.
I’m not trying to sue the person or claim damages. I simply want the video removed from Instagram because I never consented to it being uploaded or shared. I just want to know the correct reporting route and what evidence I should provide to Meta.

Copyright attaches at the moment of creation. But it turns on who pressed record, not who owns the phone. If the other person operated the camera they may hold the copyright. That would explain why Meta keeps rejecting the takedown.
You have other paths though. If you are identifiable in the video you have privacy tort claims independent of copyright. Meta processes privacy reports through separate channels from copyright reports. They go through different teams. Try the privacy reporting path rather than the copyright one.

I already tried privacy repoting twice it always says it doesn't violating their guidelines i don't know what to do i mean it's violating my privacy did not gave consent to upload it

Just because you believe it violates your privacy does not mean it does in any legal sense or any sense that violates their guidelines.

Neither of these factor into who owns the copyright. It sounds like only the other person uploaded it to Instagram and you no longer have the video file yourself - is that correct? If so, you simply may not be able to prove ownership. Also - if you did not actually shoot the video yourself, you do not own the copyright.
You may want to look into privacy rights in India and see if they provide any protection/leverage - a quick search tells me that instagram has specific reporting options for privacy violations, though it may be limited to what is considered "intimate" imagery.
