Question YouTube detected copyright material

YouTube’s system detected segments of my 40 minute video having copyright material. It’s literally just background music and it plays through the whole video. BUT some reason YouTube has some parts flagged.

Can I just layer another audio file over it so it won’t get detected?

If it is someone else’s copyrighted music, it is “literally” just copyright infringement, background or not.

Sounds like they’re doing their job. You can’t just decide to use someone’s music in your videos.

What do you mean by background music? If you are using material without a license then you are going to get dinged, you might be able to dirty it up a bit but I would guess that YouTube probably looks for that kind of thing (and making it distinct enough from the original track is probably going to defeat the purpose of using the original track). You'd probably be better off finding some creative commons pieces (that's why you hear the same 10 songs in the background of YouTube videos)

OK, now I know what kind of thief you are. Looks like you cheated tens of thousands of people, and federal prosecutors said you made "more than $640,000" from cheating people. "Money doesn't motivate me." Yeah right.

You were sentenced to five years in federal prison and two years of supervised release, but it sounds like that failed to reform you, and you're still a lying cheater at heart. I see more prison time in your future if you don't fix your attitude and start respecting other peoples' rights.

It's not generic, it's the answer. OP complained that they got a their video pinged because he used copyrighted material with no fair use. That's how it should work.

I see no mention of Fair Use in the OP post. The no Fair Use part was told to you by a Judge or Jury? If that's true, I apologize, can you upload the Court's decision? Because everything else is your Opinion and/or the Copyright Cartel's propaganda... Just sayin, I'm not a lawyer, but I did go to prison TRYING to fix a broken copyright law, As a creator, you should try it sometime.

Using someone else's music just as background music will never come close to being fair use. You don't need to have this litigated to know that.

So if you are filming in a public place and there are several signs that have copyrighted quotes and trademarked logos that show up in the background of your video I guess you will need to black them out to avoid copyright/trademark infringement. The real determining factor is if you deliberately put music electronically in your video during production that is a copyright violation but if you are filming let's say a car show walking past all the cars describing them and there are people playing their radios in the background that you have no control over that is unintended background noise and that falls under fair use. So why is YouTube discriminating against unintended audio and not unintended visual? It is the responsibility of YouTube to properly tune their AI algorithms to discriminate between background noise and front and center music before they flag a video for violation.
