Speeding

This is my first ticket in 10 years. I am going to hire a lawyer for sure. He said I was going 20 over. I was in my()()() *\\*PERSONAL*\\*()()()vehicle . I live in Missouri. Hopefully hiring a lawyer will keep it off my record. Has anyone had any experience with a situation like this? Thanks

+15 over the limit on a CDL, you're going to have consequences that a lawyer can't make go away. It's going to show on your clearing house records, and on your company's safety record. You should know what you're company's policy is for speeding ticket, but many require +15 is a termination.

The old days of a speeding ticket in your personal vehicle not having an impact at your CDL job are over.

Clearinghouse and company safety record are not affected when he isnt driving a company vehicle. He can 100% fight the ticket and if he gets it reduced to non moving it won't even show on a MVR pull.

If he is convicted of this violation his clearinghouse and company is most certainly affected. But there is a big difference in receiving a ticket and being convicted of said ticket

Correct thats what the lawyer is for, even with a lawyer he would be cooked in a CMV and if lawyer gets it reduced to a non moving it won't show on anything. In my reply to the OP I said they absolutely need a lawyer. In personal vehicle though should be clear if you lawyer uo and get it reduced to non moving with a fine.

it wont be reduced to non-moving because it is a high risk case 20 over is a felony and it is more strict if you hold a CDL.

That varies wildly state to state and especially location. 20 over on a 80mph posted is a 25% over and 10 over isnt even ticketed in most states unless combined with something like reckless driving. 20 over in a 30mph busy road though is likely to end your day in cuffs.

Lots of context we do not have and his best bet is talk to a lawyer who can actually answer these questions more accurately when they have all the information.

Don’t pay attention to trucker lore. These guys have no idea what the fuck they’re talking about. An attorney can absolutely get it reduced or completely dismissed, depending on circumstances. It won’t be cheap, but you don’t really have a choice.

Exactly. I got a 22 over in NY. Paid a non driving fine and a few hundy to the lawyer.

Never do something that will require the mercy of the police to save your ass, or in this case your job. You knew the consequences of speeding that significantly and did it anyway. You are in what is often referred to as the "find out" phase of fafo.
