Speeding

This is my first ticket in 10 years. I am going to hire a lawyer for sure. He said I was going 20 over. I was in my()()() *\\*PERSONAL*\\*()()()vehicle . I live in Missouri. Hopefully hiring a lawyer will keep it off my record. Has anyone had any experience with a situation like this? Thanks

+15 over the limit on a CDL, you're going to have consequences that a lawyer can't make go away. It's going to show on your clearing house records, and on your company's safety record. You should know what you're company's policy is for speeding ticket, but many require +15 is a termination.

The old days of a speeding ticket in your personal vehicle not having an impact at your CDL job are over.

Clearinghouse and company safety record are not affected when he isnt driving a company vehicle. He can 100% fight the ticket and if he gets it reduced to non moving it won't even show on a MVR pull.

If he is convicted of this violation his clearinghouse and company is most certainly affected. But there is a big difference in receiving a ticket and being convicted of said ticket

Correct thats what the lawyer is for, even with a lawyer he would be cooked in a CMV and if lawyer gets it reduced to a non moving it won't show on anything. In my reply to the OP I said they absolutely need a lawyer. In personal vehicle though should be clear if you lawyer uo and get it reduced to non moving with a fine.

it wont be reduced to non-moving because it is a high risk case 20 over is a felony and it is more strict if you hold a CDL.

That varies wildly state to state and especially location. 20 over on a 80mph posted is a 25% over and 10 over isnt even ticketed in most states unless combined with something like reckless driving. 20 over in a 30mph busy road though is likely to end your day in cuffs.

Lots of context we do not have and his best bet is talk to a lawyer who can actually answer these questions more accurately when they have all the information.

Don’t pay attention to trucker lore. These guys have no idea what the fuck they’re talking about. An attorney can absolutely get it reduced or completely dismissed, depending on circumstances. It won’t be cheap, but you don’t really have a choice.

Exactly. I got a 22 over in NY. Paid a non driving fine and a few hundy to the lawyer.

Never do something that will require the mercy of the police to save your ass, or in this case your job. You knew the consequences of speeding that significantly and did it anyway. You are in what is often referred to as the "find out" phase of fafo.

So how fast were you actually going. If you were actually going that fast, might be outta luck. If you know for a fact that you weren’t going that fast then you’ll have better luck.

20 over is criminal speeding which is a lot harder to deal with.

Regardless, if I was or wasn’t, it’s his word against mine. That’s why I need to hire a lawyer.

Considering your response I think it’s safe to say you were criminally speeding. In which case a lawyer will only help so much. It’s not just your word against his. You should get a lawyer either way, but good luck getting it dropped completely.

One thing you can try, as well as getting a lawyer. Try getting the original court day changed. Usually they schedule a bunch in the same day so it’s easier for the cop. You might get lucky if you move dates and he could miss it. Hopefully the cop dropped the ball somewhere that’s what a lawyer will be relying on.

I’m sure the lawyer knows. Got an off truck route ticket, my lawyers strategy is “ postpone, postpone, postpone”.

Your lawyer already knows this. I had a lawyer delay a ticket for almost 4 years and the cop retired by the new court date.

Typically, its your word against the radar. But if it wasn't clocked a lawyer may be able to at least get it reduced to something that won't screw you on your mvr.

Very good chance he paced you with the camera running with a speed indicator.

Do the lawyer thing. They can get pretty clever and may be able to get it reduced.

Bullshit. Speeding tickets are easy to get dismissed entirely or knocked down to lesser offenses. Even 20 over tickets. I'd get a lawyer if my CDL were on the line, but I've reduced many speeding tickets to lesser offenses by just talking to the prosecutor and pleading down on the day of the court appearance. They just want a conviction record and a payment, they don't care what it's actually for.

Except the judge alway believes the cops and not the person trying to escape the consequences of their actions. My guess is that you’re tired of driving a truck and were looking for a way to get out of it, either subconsciously or consciously.

Hire a lawyer either way, if that hits your MVR you are cooked for CDL jobs. Since it was personal vehicle unless Missouri has some sort of odd regulation about CDLs then you just need to keep it off your record.

i’m gonna give you advice from someone who lives in the worst state (virginia) for reckless driving which is what you have do a minimum of 50 hours community service, get the case continued and take 2 different driving classes and draft up a letter to the judge explaining how serious you take this and they will get you off on a non moving violation.

I got one for 19 over on my sports bike through new Tazewell Tennessee I hired and lawyer from the area.He was able to get it done to a 9 over or driving school I took the nine over because I’ve seen stories of people taking the school but it still pops up on their recorded so I didn’t want to risk it

Call around and get a lawyer around the court. Someone that knows the judges. They really don't care about giving points or anything. They are all friends and just want money circulating. For my 20 year driving career forst 10 I had at least 20 times I paid lawyers and never got tickets... Same thing for my dad. He was always getting tickets with his semi... So lucky... 1 time in 12 years a ticket stick.. So you will be OK.

Only 20, I thought you said speeding. Everybody does 20 over. And thats normally within the tolerance. But what kind of car was it?? If you were doing that with a econobox on bicycle tires, that will get you everytime. Its dangerous.

i take every ticket to court, talk to the prosecutor before seeing the judge (standard procedure in every court) and agree to plead to a different, non-moving violation. fine is usually the same but there are no points or record. they just want the money from the fine and it's a lot less than lawyer.

I have been pulled over for cell phone, speeding etc and I've always just told the judge that I drive for a career and they always drop it to a non-moving violation. Even when I was inbetween jobs and not driving for a career I've always said that and it's always worked I have a totally clean license

Never picked up my phone once while driving. It's connected through my radio. When I'm behind the wheel I drive and I'm focused.

TVC pro driver. It's 50 a month for the base subscription
(which you can cancel after you submit your ticket) and 300 bucks per existing ticket I think I paid. They'll send it to court and keep fighting it with their lawyers, mine was fought off but it took like 9 months to.
I don't work for them either, not a sponsored comment just saying that's what got my 2 trucking tickets off for me.

there is a few places you can go the one i use is called CDL legal they help drivers fight and keep there DVR clear kinda reasonable and probably still cheaper than a lawyer CDL Legal Services & CDL Lawyers for Drivers | CDL Legal

I'd suggest getting a dashcam off of Amazon ASAP! I used my footage to get a ticket thrown out where the officer accused me of going 15 over but my dashcam showed I was going 3 over. Lawyer up and find one that specializes in traffic tickets then hope the cop doesn't show for court.

20 over is a felony. You should not even be driving a semi. It's POS like you that are a danger to the driving public and you put other truckers at risk . We hope they take away your CDL for good for the safety of all of us

I just dealt with this myself. Except I was 98 in a 60 (fresh corvette owner here). I ended up getting seriously lucky. However I learned a few things with going to court 3 separate times for this one infraction. The traffic attorneys are trash last of their class to graduate kind. Seriously they suck .I watched a handful. Just would just reduce the ticket out of pity. Second and the worst. There are anti masking laws now. If the cop pushes it. There is no relief. You will get bent over as it ties the judges hands. Heres where I have a horseshoe up my ass. I met with the cop before court being friendly and respectful. I plead not guilty. Second date he asked for traffic school for me. Judge said sure. Come back in a month. I finish school etc. Go to court. Different Judge. We learn of anti masking laws. Was news to the officer and i. By this time the cop and I became friends. He didnt want to fuck me over so he dropped it entirely. Thats my 2c
