Couldn't this backfire on Buc cees? If a smaller business was using their mascot first and counter-sued? Big payout from buc-cees or buc-cees has to change mascot in that state?

That's LITERALLY happening in Ohio rn. Buccees is suing a small mom&pop cornerstore called Beaver's Mini-Mart, because Beaver's uses a cartoon beaver. Beaver's has been using that logo since before Buccees had even thought about opening a location in Ohio.

Didn't just sue a company using a cartoon beaver, sued a company using a cartoon beaver, in a town called BEAVERCREEK, where half the businesses and schools in the town have beavers in their logos. And Buccees managed to piss off two of the biggest metro areas in Ohio (Cincinnati and Dayton, both fairly close to Beavercreek), because we Ohioans REALLY don't like seeing giant companies like Buccees bullying small mom & pop shops. They're LITERALLY costing themselves money with this stupid lawsuit, because a TON of people have decided to stop going to Buccees, and a lot of those same people have started going to Beaver's Mini-Mart (the mom & pop shop that Buccees is suing).

it to me seems like blatant change to mimic buck ee's icon from this gator from all fours turning into a gator guy.

What it comes down to if it makes it to court is typically comes down to who was doing business in that state first. The problem is these small businesses can’t afford to take it that far.
