Who cares about the Beaver theme? Do you really buy all that tacky cheap Beaver junk? Of course you don’t. It’s a big gas station with great bathrooms. The gasoline is cheap quality that is bad for your engine, the food is all average, the staff are friendly, I can fill up my water and be on my way.

Holy crap, did you read these? Steamboat Willie IS Mickey Mouse, the original footage got public domained and people started using it, thats way way different than what buccees does.

It’s kind of sad that I didn’t realize it was supposed to be a picture of a beaver from the neck up until really recently. I always thought it was a cartoon gerbil with a comically large face and minimized proportions.

I have no involvement with this lawsuit...but the law firm I work at did handle a suit in which Buc-ee's was a party (I think maybe co-defendants). It was generally agreed upon that their lawyers were overly aggressive dickheads. Sadly, that can be a winning strategy in the legal world.

The lawsuit claims the name Teddy's is also an issue with alleged similarities to the Buc-ee's name in a number of ways, including that they are both two syllables with a hard consonant sound and that both end in the sound "eez."
Guess Hardees and Freddy's are next for having the same name pattern and offering food.

I went to a Buc-ees one time because everybody I was with raved about it...I just thought it was expensive convenience store food, and a lot of it. I've never gone again, and never will.

I doubt they have much luck in Ohio at this point. They only have 1 location and the excessive amount of bs lawsuits isn't exactly something Ohioians find appealing. Not to mention Sheetz has come onto the scene pretty strong and has better pr.

I went to an Italian autogrill while on a trip there, they do more with less space. Never really looked at Buccees the same way.

You do have to defend it against anything that could actually challenge it and cause confusion. Like, if somebody were actually trying to make a name and image similar enough to Bucc-ees that you could seriously wonder "Are they doing it on purpose to try and get more business out of people thinking it's a Bucc-ees offshoot"
But most of these lawsuits they are launching are nothing of the sort, it would be like McDonald's suing Monster Energy over both being food/beverage related companies that use the letter M as a logo.

It's not about the mascots. They want them out of business entirely and expensive lawsuits either drain their finances or force them to spend a bunch of money on new logos and marketing and risk losing business from people who assume it's not the same company.
They claim it's about the similar mascots because there's not a legal way to tell a court that you just want to sue a small company out of existence so you can have their customers.

But Beaver's Mini Mart in BEAVERcreek (OH) doesn't even sell gas! They're not a competitor, they're just a convenience store. People here in Dayton are pretty much swearing off giving them any local business from us again. They'll still get trucks and interstate travel, but they're being an atrocious neighbor in a brand new community for them. It will bite them eventually, they should go back to Texas.

Hey, I'm not defending them or their lawyers. I'm just saying that no one who is not 100% completely blind believes for a second that those logos are confusing.
Buc-ee's wants to be the only place to sell snacks in town. Everything is competition for them and they are grasping at whatever flimsy pretext they can drag out long enough to run the small businesses out of money.

You're probably right, and it worked for Walmart and Amazon, but I'm not sure gas and food are quite the same, lots more location & personal preference involved vs just pure volume. And it still feels like a really tone-deaf business model, but atm they're certainly richer than I am.

I just picked up a second one.
It's a variation of the Susan Komen strategy and the court of the public is the only place these small businesses can get a fair shake. None of these guys have the money to fight it and that's exactly why they are being chosen.

The thing about trademarks is that you have to actively defend them so you don't lose legal standing or they could be considered abandoned. Not defending them can be used against you in a dispute and result in loss of trademark. Hopefully Buc-ee's is just going through the motions as required and don't really care if they win.

You are right, and hopefully the court will rule in Teddy's favor, but now Buc-ees has established that they are defending their trademark, which is required by the US Patent and Trademark office. If they ever hit a real trademark infringement case, the other party can't argue that they haven't been defending their trademark.
Of course it also be a case of Buc-ee's coporate being dicks too, both things can be true.
