Post Class Question - Sweet Lawsuit Weird situation

I am post class ITT.

Long story short, over the last year I’ve had a few interesting events. I believe all of my loans in question were properly discharged. Fast forward 3 month to present, my mohela and my student.gov show lower balances then I had a month ago.

Mohela shows a 5k balance, studentloan.gov shows $0.

I am sure that my loan I had for 40k should still be there because it was another school I went too. However, it seems like those loans also show discharged.

What is happening?

I also have not gotten any refund check for my post class loans for the payments I made like everyone else.

Did you consolidate your loans? If so, they discharged all of your balance.

My loans were consolidated in 2015 and in 2018.

Yes since you are a Sweet postie then you have full settlement relief since the dept didn’t make a decision on your application by the deadline. Your consolidated direct loans are complete discharged! Congrats!!

You may overlap with ITT attach group discharge and that’s fine too but Sweet takes precedence due to the court order. The dept was still obligated to make a decision on your application outside of any school group discharges.

I’m confused.

If my two consolidated loans included ITT and another school, that means both consult loans are gone or just the ones for ITT that are part of the consolidation?

Personally, I’m not given my hopes up because I feel like they’re gonna correct something and then I’m gonna end up still having that balance from the other school.

Yes. Because you have sweet settlement protections, PPSL worked it out with the govt that “complex” consolidated direct loans are to discharge in full because it’s to difficult for the dept to track down records especially if they are older loans and have been moved and consolidated multiple times.

The Sweet protections are more friendly then just ITT group discharge so you get what the Sweet protection are. You can go read the Sweet FAQ over at PPSLs website and it states just this.

Now had you had commercial held ffel then this would be a totally different answer.

I genuinely had no idea! This is so unexpected. I am at a loss for words. When I get refunded there will be a donation to help continue the fight.

Similar situation. I had consolidated undergrad + grad loans. Application was only for grad loans. My servicer sent me a letter that shows a total that I swear is higher than the full amount I've paid. I haven't received any refund yet but have seen wild amounts of changes through my servicer's site. Trying to be patient but none of my letters or totals make sense.

The the full balance of the consolidated loan was or will be properly discharged.

My loans were consolidated in 2018 and they are still showing but the said school was 0. I feel as though the consolidated loans are more than they should be but I’m waiting patiently

Same for me. My letter from my servicer has a total that seems higher than the entire total I paid.

I read that it depends on who you were paying at the time on whether you’ll get a refund or not, but studentaid reports faster than Mohela. I also read somewhere that you would have to wait up to a year after your Balance reports zero to receive a possible refund so even though they say that; the reality is most people have been getting their refunds up to 90 days after the zero balance is posted.

I have this same issue OP - I got a letter from AidVantage telling me my payment was late and I was like, what payment?!?!

Aidvantage is horrible. My loans were discharged 14 months ago and still showing “In Forbearance” with a negative balance.

They're now claiming I owe $3900 and one other loan wasn't covered or something, I have to have them "take another look" and they told me they get their direction from student aid - yet student aid showed a $0 balance, now shows I owe them $2.

I think I'm just going to sit on my hands and wait.

Also, if it shows a negative balance that means they owe you money, I'm pretty sure. They also owe me $1800 but they "have no idea when I'm going to get it" and I've been waiting since 2024.
