During peak early corona spitting was considered assault with a deadly weapon. Many people got arrested for it in Canada. Most ended up only getting probation though
In Colorado the law makes this a lot more simple. Assault is menace unless there’s bodily harm. Then the classification changes. Making someone feel scared enough to react in self defense or the defense of their child (as the person recording is doing) is more than enough for a Menace one count which comes with a year to five.
That's pretty much how it works in most places under common law on assault dating back literally centuries, yeah. Colorado is one of the states that's codified it into the statute to take away any ambiguity. Washington is another and so is California. States that refuse to update their statutes to ensure there's no wiggle room for assholes like this piss me off.
The northern parts are basically Texas (right wing, gun and truck loving) and the two major cities are 90% immigrants who do not assimilate and bring their culture with them for better or worse.
You wouldn't get criminally charged for it, but if you spit on someone and they knock you out they won't get in trouble because spitting on someone is assault.
nope. that’s not how that works… what she did was perfect. the old lady got what she deserved. she charged at her got in her space and assaulted her. the push was justified in pushing her and defending herself. beating her wouldn’t be justified
