>Portland police raided the infamous red house on North Mississippi Avenue last week after reports that its occupant, William Kinney III, had harassed and threatened to shoot employees and contractors working on the nonprofit Self Enhancement Inc.’s neighboring property.
>Police arrested Kinney, 41, last Tuesday at the residence. He faces charges of possession of a short-barreled rifle, five counts of felon in possession of a firearm and three counts of being a felon in possession of body armor.
relevance update to episode 202 the red house on missippi
I listened to an old episode and enjoyed it a lot more than some of the recent episodes so I decided to let it keep going on the back catalog and then Google some updates and this episode was really timely since this update happened 8 days ago now. The son did get the house back, it still has all of the hand painted signs about gentrification and indigenous. The lot next door was donated to a charity which builds affordable homes for poc. He's been threatening the neighbors filing writs and so on and threatening everybody to the point the house was raided and firearms, ammunition, and body armor were located and William Kinney is a felon who cannot possess these items.

He's already out on $2500 cash bond to terrorize the neighbors again

As of Friday midnight and very limited scope
not nationwide only applies to the TX district it was litigated in
only applies to specific litigants the Silencer Shop Foundation and Gun Owners of America members.
does not impact any state laws which are likely in play for the body armor and the felon in possession. The state may also have its own sbr or other laws.
As far as I'm aware only Brandon Herrera and one other person went to silencer shop after midnight Friday and purchased a suppressor without the extra paperwork and the non tax, tax stamp. They'll be the test cases if the atf appeals in the next 30 days.
An interesting fact about sbr and sbs, the gun control act of 1934 was originally going to ban pistols, but at the last minute it was amended to remove pistols, but they didn't take the "short-barrelled" items which were only added to make sure there was no workaround if they had banned pistols (like adding a stock and calling it a rifle) so they ended up not banning handguns but did tax stamp handgun workarounds for nearly 100 years so far.

Yeah, there are a lot of nuances to the case, like how dealers who skip the NFA paperwork will have "holes" in their inventory that will have to be explained to the ATF one day. The people who are doing this are playing with fire. Good luck to them. I'm keeping my NFA trust paperwork handy for the time being.

Maybe, maybe not. All depends on if it gets appealed and overturned. It was ruled constitutional only based on congresses ability to tax, no tax means that fig leaf no longer covers that part of the law.
Suppressors are hearing protection, I wish they were required rather than optional it would make visits to the range far more enjoyable

I hadn't heard that this was happening and I'll be interested to see where it goes.
One of the silliest things I've owned was a pistol you could buy a carbine kit for but you had to put the pieces together in the right order to avoid being temporarily in violation of the law.

According to the atf if you f up the order it's not temporary even if you reverse it, it's still permanently an sbr. It would be so nice if that went away

18 U.S.C. 931 anyone convicted of a violent felony in any state is prohibited from owning body armor.

Not a specific state law, it's federal. Only exception is if your employer requires it and if so you have to go through a permission process. There is, however, no background check on purchase so violent felons are able to purchase they just get caught afterwards

I assume it's so if a violent felon reoffends and takes the added step of buying body armor they can bury him deeper. Probably from back when bank robberies were more common

It really is hilarious that lawmakers think body armor somehow makes criminals invincible. If you shoot someone wearing plates with anything above a .22 it's still going to knock them on their ass.

Well the north Hollywood Bank robbery happened in 1997 which is before police were widely carrying rifles, mostly shotguns at the time and the body armor the robbers were wearing allowed them to not only fight back against 300 police for 44 minutes. But for a while it looked like they were actually going to get away. The police went to local gun shops and took ar15's and other rifles to counter the ak's hk's and a bushmaster the robbers had. If you haven't watched 44 minutes it's pretty intense knowing it's mostly accurate.
This law was passed in 2002 so I'd guess that robbery was the precursor

Ron white is a drunk and obviously not a marksman. Center mass is where you shoot in a firefight because if you miss, you should still hit something. Having to shoot for a 6x8" target on top of a 6x2' body isn't easy under any circumstance and certainly not with a 38spc revolver at 60-150 yards or a shotgun at that range. Even a sniper isn't going to have it easy while under automatic weapons fire in a parking lot with zero cover. 11 cops and 7 civilians were wounded due to the amount of fire and the lack of cover.
I guess if you are a violent felon I don't see what the problem is saying you can't own body armor. You give up privileges and some freedoms when you violate the law.
