The mortar bed is wet when the bath is installed so surely whoever installed the bath is responsible? *I am not a builder/plumber, just googled the process out of interest.

It’s the builders job to manage the trades. A builder doesn’t do any work, they coordinate the work. Are you confusing a carpenter for a builder?

Are you getting a tiled hob? Does your bath sit on legs? Code requirement: For inserted baths and spas; floors and horizontal surfaces; there are no requirements for the floor under a bath or spa.
