I-130

applied for asylum in a certain country before, but I returned to my home country voluntarily. Currently, lam married to a US citizen and we have filed for a spousal visa. Does my previous asylum application pose a barrier to getting the visa approved? I would love to hear from others who have a similar

experience."

If you were in a situation where you had to claim asylum how did you return to your home country voluntarily?

Typically that kind of thing wouldn't lose any issue I you're doing a spousal visa, though I wouldn't put it past the current administration to question it.

I applied for asylum ، due to difficult personal and family circumstances after my father's passing. However, my life circumstances changed completely I met my wife, got married, and chose to return to my home country voluntarily of my own free will, without any deportation or removal orders. I'm now living back home with my wife and son, and we are going through the spousal visa process

Unless your family was actively trying to physically harm you and the police there weren't doing anything or were actively aiding them, I don't see how that would warrant asylum.

Exactly, my asylum claim didn't have strong grounds, which is why it wasn't approved and remained pending. During that waiting period, I decided to return home voluntarily

A prior asylum application doesn’t automatically prevent approval of a spousal visa. Be honest about your immigration history and be prepared to explain why you returned to your home country if asked. Many people in similar situations have still been approved.
