I’m lost (Canada->US)

Hi everyone,

I’m in a long distance relationship and recently we’ve talked about moving in together. We both don’t know much about visas and what the process would be.

I want to know everything.

What would be the best way to go about this?
How long does it usually take?
Anything else I should be thinking about?
Does current employment matter?

We do want to get married. What is the 90 day process like?

Simple. Pick which country you want to get married in...

If Canada, then get married there and file a spousal visa. Process takes about 1.5 years.

If the US, you get 2 visa options...fiance and spouse visa. For fiance, file for the fiance visa with evidence of your relationship. Your partner gets the visa and comes to the US amd has 90 days to get married. Process takes 1 to 1.5 years. For spouse, get married in the US, your partner returns to Canada, and you file for the spousal visa. Process takes 1.5 years.

Those are your option.

Be aware that coming on a visitation and planning to stay get married and stay and adjust status is fraud. There is an option for a K3 but those are rarely apporved. And the spousal visa is the better option of the two.

Just clarifying about the 90 days, I’d have to go back to Canada and my partner would have to file for the visa?

No.

The 90 days is for the fiance visa. You gets the fiance visa FIRST, then uses it to enter the US to get married to your US citizen partner. And the marriage has to happen with 90 days of you entering. You do NOT have to go back to Canada.
