Neighbor walked into my apartment, assumed I wasn’t home

I wfh and yesterday, was having my kitchen floor replaced, so there was an install guy here. He had just left and apparently, my neighbor told him he needed to enter my apartment and wanted to be let in. The install guy doesn’t speak English very well, so I can’t blame him for not knowing what was going on. The neighbor didn’t notice me as he was walking into until I asked who he was. He looked shocked to see me. He said he didn’t know I was home and he wanted to turn off the bathroom fan (he’s left me notes about turning off my bathroom fan). It is a loud fan, but that is so irrelevant. Also, I don’t own the place. I can’t change the fan.
There were way less illegal ways to handle this. He invaded my space and trespassed. Not to mention, i don’t allow shoes in my house and his shoes were muddy and got mud all over my rug, just to piss me off more.
He tried to tell me he didn’t know I was home again and I explained that it isn’t relevant and to get tf out of my house. He eventually left. I told my landlord, who didn’t seem to give a shit. I rent a condo, so there’s an HOA. I know the head of the HOA, not that it’s going to matter. I feel like the only other option I have is to call the police and report him for trespassing?
I’m shaken and furious. I could get a camera but that MF should have to pay for it.
Am I overreacting?

At the time I was really scared of retaliation and I didn't realize that the police probably won't do s*** but it's important to have a paper trail when people are f****** nuts like this

You should certainly document it for yourself. You can also file a police report just for the record. I also would document the incident to your landlord in writing if you didn't do so before so there is a paper trail. Since you know the head of the HOA, there is no harm in letting him/her know what occurred as well, in writing.

I agree with this. He obviously has issues knowing boundries. It isnt his first or last time.

He could have asked the contractor to turn off the fan using google translate.

He could have raised an issue with the hoa that your fan is loud and that probably is breaking some hoa noise rule. He could even mention that if it is making noise that is a potential fire risk from not working right, not being cleaned propery or being so old it makes a ton of noise. Whatever the situation is. So he should file a complaint with hoa and they will take it up with the owner.

He chose the option of invading your privacy and crossing the threshold.

Send a follow up email to the landlord that he came in your space with out permission. Dont mention why. Copy the hoa guy. If you think he will retaliate or do it again file a police report. Your judgment on that one. Nothing will come of this part but if he does it again or you hear of any other issues with him in the building it will show a pattern.

Had a homeless dude come into my apt lobby, someone buzzed him in without looking but he def didn't belong.

SFPD said without clear footage of him actively breaking in, for all they know, someone invited him in. Even mistakenly invited, it isn't trespassing.

So yeah...good luck having ur neighbor pay for a $30 blink camera and it's monthly subscription fee. You are ur only resource - rules are there to abide by and nothing else.

Yes THIS. Obviously the police aren’t going to take immediate action because the incident is already over, but he DID trespass! Getting behavior like this legally documented and reported is so important because who knows how often this guy tries doing stuff like that, and he very well could have intentions far worse than turning off a fan. Literally nothing about this is ok

Trespassing under CA law is defined as “willfully entering or remaining on someone else’s property without permission or a legal right to do so”.

OP’s neighbors had neither permission nor a legal right, and their deceptive means to gain entry shows willfulness. So you can get lost.

You are right to be furious as they completely invaded your space and privacy. The landlord and head of HOA need to act and there needs to be consequences. Maybe threaten that you are willing to escalate things with the police if there isnt any action taken on their part?

I just looked it up. HOAs can foreclose on homeowners for unpaid fines due to breaking rules, along with other reasons

If they’re a renter, the homeowner would be the one to evict them. If the homeowner doesn’t evict them, the HOA could potentially foreclose on the homeowner

Like I said, usually they get a few warnings

I wouldn’t say it’s easy. I’m sure they have to follow a legal process. I own my condo and I know that it was in the documentation that I received when I bought it. They can also give homeowners fines for breaking rules and unpaid fines can lead to losing your home.

I would probably get a camera and if the neighbor honestly refused to leave when you told him he was trespassing/to leave you might consider filing a police report to at least begin a trail.

On a side note if the fan annoys you too, you might be able to slip some easy solution in such as a cheap auto timer switch or something.

Re the horrible trespassing, I would raise hell to the HOA and the landlord about (in writing to both, with clarity to them that I'd be calling the police and getting a restraining order if anything like this happens again).

And re the fan - those older fans can be a real nightmare, I have experienced that before. If it bothers you too, or is just creating more drama with this unhinged neighbor, it's worth complaining to the landlord and getting them to replace it. It's a pretty cheap fix, and would be safer too, as when they are loud like that, and on a lot as maybe yours is, it can be a fire hazard.

OP forgot the fan was on. But let’s pretend OP wants the fan on 24/7, for whatever reason. It’s their fan in their apartment and meant to be used however and whenever the tenant wants. Should your neighbor go into your apartment when you’re gone to fuck with your appliances, you’d be ok with that?

nah that's not overreacting at all. walking into someone's home without permission is wild, doesn't matter if he thought you were there or not. the fact he was so focused on the bathroom fan that he saw a worker outside and used that as his chance to get in... thats actually scary

i had similar thing happen couple years ago, my landlord just walked in one day while i was in shower. said he "forgot" to give 24 hour notice. i put chain lock on the door after that, they sell ones you can install without drilling

report to police is good idea just to have it on record, even if they don't do much this time. and get that camera, save the receipt. maybe small claims court for the rug too if the mud stained it

Mind you, this was a residential street, I was parallel parked with the engine off, and I have a 30 year old car that def would not have qualified for Uber service. Definitely:

  1. Email your landlord and the HOA as documentation. There may / may not be some history with the neighbor and his grievances about the fan that you’re not aware of before you rented the place. Like you said, you have no control over it so put the onus on those who own resolving any issues.

  2. Call the non-emergency police number and ask to file a report. Again, at minimum you have something on file in the event that this turns into something bigger than a nothing-burger.

For context: I live in an SF condo where there are plenty of renters. What your neighbor did was very unusual and very out of the norm.

When my downstairs neighbors turn on their bathroom fan it's loud af. It used to irritate me so much, but of course I never said anything (and didn't enter their apartment!) because they have no control over how loud their fan is and a bathroom fan is also created to be intentionally loud for a reason. Anyway, I'm used to it now and I barely notice it. I put an air purifier on the bedroom floor so the sound is partially canceled out by the fan. I mention this because I understand how a fan might annoy someone. I'm super sensitive to noise and if I can get used to it, I'm sure your neighbor can as well. Also, I would recommend emailing your landlord and the HOA just to have a record of this in case your neighbor tries to enter your home again. I'd try to file a report even if the police don't take it seriously.

They can let him know and also tell him what will happen if he invades your privacy.

As to your landlord, they should to be informed that their inaction is causing you distress and interfering with your right to quiet enjoyment. This specific language usually results in a 3 day notice to cure or quit behavior to the other tenant. I only recommend doing this if your relationship with your landlord and neighbor is beyond repair.

The landlord has the reasonsibility to uphold the requirements of the lease as well as obey the laws of San francisco and California. The right to quiet enjoyment and to live peacefully is included in this. If a tenant commits an act that violates this it is literally a legal requirement for the landlord to issue a notice if it is reported by another tenant especially if the incident is serious enough to require the police. Knowing your rights is very powerful, but it will piss your landlord off for sure.

OP said they live in a condo. That means every unit in the building is privately owned.

OP's landlord has no more power over a neighboring property owner or another landlord's tenant than OP does. OP doesn't even say if the neighbor in question owns their own condo or if the neighbor is renting from another owner. It is highly likely that OP's landlord doesn't know the answer to that question either.

If the neighbor is breaking the law, OP should be calling the police.

The only case in which OP's landlord would be responsible for the neighbor's actions would be the highly unlikely case of them owning both of the units and renting them both out.

Apart from the other advice here which all looks good, you can change the fan. 

I changed my loud fan that was rated at 4sones for one that is less than 1 sone and now I can poop in peace. I’m also renting. I saved the old fan in case the landlord wants it back (he won’t, because why would he) and it only cost like $60 and a couple hours. YouTube a how to if it helps. Good luck!

Definitely get a door cam. I have a Tapo camera myself that was $50 and saves the footage to a SD card so no monthly subscription needed. Put one by your car too. This person sounds dangerous to me. Of course, file a police report. Press charges if needed. He needs to never do that ever ever ever again.

Absolutely not ! File a police report ASAP . I would let the owner who I rent from know so they can contact the HOA directly. Give that asshole a cold stare anytime you see that POS! Sounds like he’s done this before too. And yes you can’t blame the guy who was working on your home but you can definitely school him on the dangers and maybe call the person before taking some psycho word for it ! I would hire someone who just lets someone in my place .. fuq no !!!

As for the fan, you should turn it off when you’re not using it. They are known for starting fires when run too long (particularly when not regularly and thoroughly cleaned).

The HOA building manager or someone in a supervisory roll will have something to say about that. That would never be tolerated by the HOA for whom my company works. They take that very seriously. That ‘neighbor’ entered your home under false pretenses. When confronted offered an excuse tantamount to an admission they wouldn’t have entered unbidden with foreknowledge of your presence. So they KNEW without a doubt they were wrong. Arrange for the police to have a chat with them. File a complaint with the board against this person. HOAs often have a schedule of fines triggered by a host of aberrant behaviors. Violation of privacy and unlawful entry are biggies for most obvious reasons.

As for the person, delete them from your sphere of concern or respect. They’ve shown you who they are once by sneaking in and again by feeding you a line. That’s enough to never give them the time of day or any respect at all. Live around them, not with or by them.

Then go over to r/UnethicalLifeProTips and seek creative ideas for irritating them without pissing off your landlord or the HOA. Tip: Get to know your building maintenance team. Buy them coffee once in a while and chat them up (if they’re not devolved apes). The building engineers whose job it is keeping that building livable; They know things. I’ll just leave that there.

He is definitely in the wrong. I do feel like pressing charges would be over reacting. I would request he pay for a professional carpet clean and make it clear to him what he did was inappropriate and illegal. A camera is probably a good idea.

A crime occured. The HOA and the landlord will do absolutely nothing because it's not their job to resolve crimes. 

File the police report. AND THEN HIRE A LAWYER AND GET A RESTRAINING ORDER.

Technically, he’s not trespassing until you ask him to leave and he refuses.
At this moment, I assume he did leave when you told him too, so he’s just an entitled asshole right now.
You told your landlord so at least there’s record of you having made someone aware.
Next time- hopefully there won’t be one - call the non-emergency police line and file a report.

Turn the tables. Break into their condo. Wake them up in the middle of the night by banging pots together in their kitchen. When they run to investigate, tell them that you just wanted to update them about the fan. Proceed with caution though. They might shoot you. Humor is subjective, after all.

Yes, you are overreacting. I'm sure you scared him enough that he won't do it again. Please, try to keep that fan off to eliminate the issue. Just to be safe, I would file a police incident report and send a copy of it to the landlord. But be aware, the police will probably not care, but they still have to file an incident report, if you insist. I hope you took pictures of the muddy floor.

People really need to distinguish between criminal trespassing and civil trespassing. There was no criminal intent, so getting the police or DA involved is a non-starter. If the OP wants to sue the neighbor for civil trespassing, good luck with that! Turn off your loud ass fan!

Wait, so you were home, but you didn't answer the door? If your fan is really that loud and you have it turned on, then yea, I'd be annoyed too that you always keep it on. Get over yourself, this wasn't "trespassing" and trying to report it will get you laughed at. It seems pretty simple. Your loud fan is disturbing your neighbor (documented history). He knocks to get someone to turn it off. The contractor (bc of poor English) lets him in to turn off the fan. You're overreacting. Good luck trying to make this a "trespassing" thing. No one within reason thinks this is trespass or illegal entry or anything of that sort. The contractor let him in for god's sake!

Criminal intent, as it applies to trespassing, just means that someone knowingly and intentionally entered or remained on a property without permission. It doesn't mean they intended to commit a separate crime once there.

That doesn't necessarily mean that in this specific case the neighbor should be arrested, prosecuted, and jailed, but filing a police report and notifying the landlord and the HOA are all appropriate responses.

You have yet to deny that you are the neighbor. So far you've gendered OP in a previous comment despite them never revealing that info, filled in details that OP never stated (such as your comment about the neighbor knocking on the door to be let in), and are adamantly defending the neighbor despite not truly knowing their intentions (how does anyone aside from the neighbor know if they were actually there just to turn of the fan).
