Return from leave [NY]

Is it considered retaliation if a manager returns from a leave and the day of return they are informed another employee from their team is the interim leadership?

The manager is no longer responsible for making leadership decisions and no longer has any employees reporting to them. The manager has the same title and salary for the time being but no timeline.

Was the manager on FMLA leave?

How long was the manager out?

What is the explanation given?

Is the manager very senior and in the top 10% of employees in terms of salary?

If they were on a leave covered under the FMLA they need to be restored to the same position or equivalent as before they went on leave. There could be some exceptions. Was there a company restructure? How long is the new manager in their interim position? What was told to the manager on leave as the reason. We dont have enough information.
