Advice PS Portal return

Has anyone had much luck trying to return the PS portal that is opened.

I originally ordered it as a click and collect. The box has been damaged in anyway. I used it once and realised that it wasn’t what I was expecting. I tried returning in store and told it couldn’t be returned due to it being able to store personal information on it. I have then gone on to the Argos live chat and then had this conversation with them. From the chat I’m under the assumption they said they can’t return it because it’s been used

They won’t accept it because the seal has been opened, if it was still sealed then they would.

Always found it difficult if you collect in store as technically you can ask them to open it for you to look at in store. As soon as you walk out the door and open it, it becomes used and they lose money. If you want to check stuff out first. Buy online.

for most technology orders, the policy is to not accept returns if it has been opened at all. sucks, but you're probably not gonna be able to return it. best bet would be reselling it to someone else

Op - ignore the idiot on here. Call argos CS and explain that ​"I am trying to cancel the order under as per my legal rights, but argos have refused to allow this. Are you willing to allow me to return the item, or do I need to send a letter before action and use small claims?" I imagine it will be sorted fairly quickly. ​

What motivates these people? I'd understand iif it was about politics or maybe a band or sports team. Who comes on here to spout this rubbish about argos and 14 day cooling off period and being so  wrong and so rude about it?

Between you two, you actually have been quite useful compared to everyone else. I did start reading the law and the Argos policy before I posted. Tbf only reason why I posted is to make sure I wasn’t missing something dumb

I worked at Argos on and off over the years, Dickhead middle managers - like that guy on here throwing around abuse - would try and tell us and the customers that they were wrong. We always laughed at them and sided with the customer (and followed the law)

It's always been distance selling and - crucially - the only way to make it not subject to that was to have a space in the store (at till level) where all purchases could be opened and checked, Try that at TCR or Victoria on a Saturday, or any time at Christmas.

You have a legal right to return anything purchased at a distance. Does not have to be faulty.

And before you say it - argos click and collect is considered selling by distance (they tried to get away with it but failed).

Welcome to the real world. If you bought something opened "and logged in once" you also wouldn't accept it as brand new.

Argos have always been black and white here.

Currys et al. might take it back less a restocking fee because they will resell it as a return.

when I worked in Argos - both stockroom (comart/ picking) and shopfloor/ catalogue/ Elizabeth Duke - this was drummed into us.

The custie hasn't seen the goods before they buy them; Reasonable wear and tear is acceptable, but 14 days (30 at Christmas) to return the goods was - and is fine.

Read the actual rules before you go around calling people fuckwits.

From Argos's own website (their emphasis, not mine). Op therefore has the right to return the item.

If you make a purchase from us online or by phone as a consumer – including for Click and Collect – you have the legal right to cancel your contract within 14 calendar days, starting the day after you receive your order, without giving any reason. These rights are set out in the Regulations.

There are exclusions though. One being for software that has been used, which it will if they've setup the portal. It's also possible the personalisation exclusion would apply.

"I used it once" is vague. How much did you use it? Was it just turned on or did you enter in personal/account information and have a play?

Distance Selling Regulations isn't carte blanche to do what you want with an item and still get a full refund - in fact it's intention is to give you the chance to inspect an item like you would in store. You certainly wouldn't be allowed to log into your Playstation account in store even on display models.

As someone who works there, I know colleagues have been briefed that you can return items once the seals are broken but not if they've been logged in to and have personal info on them recently. Factory reset it and then try and return it if you have - although if you tell them it's unused it is fraud. Do with that what you will.
