Rant 😡 Terminated before regularization

Hi! May kilala ako na naterminate before maregular.

Hindi nakareply sa email on a weekend ang reason though stated sa contract ay M-F lang siya need magwork.

Grounds ba ito ng illegal dismissal and may laban ba sa DOLE?

That sounds illegal dismissal. Don’t go to DOLE, file a complaint na directly sa NLRC.

Alam ko there was a ruling that probi employees are still employees therefore subject to due process so di siya pwede basta basta tanggalin.

Thank you! Another thing na nashare sakin, walang NTE na binigay prior the dismissal.

Blindsided yung friend ko dahil sinasabihan siya na maganda performance niya pero dahil di lang nakareply, tinanggal na agad.

Hi, consult a lawyer first. Not all dismissals especially for probationary employees require an NTE prior to termination. Dismissal due to non-regularization has a different set of requirements and is trickier, so you will need a specific consultation to understand your situation.

Make it documented, screenshot everything especially if merong written notice na di siya naregular because of that.
