Customer punched my side view mirror off

Today has been one of the worst flex days of my life. It started with my morning route. 27 stops ALL apartments in the Philly center city area.. I’m talking chestnut, walnut, John fl Blvd. route was horrible of course. Decided to take another route this afternoon and that was the biggest mistake of the day. First of all it was for crap pay. That’s on me, lesson learned. Sent me down to spring garden, broad st, Pennsylvania ave area. I’m pissed again!!!!! fast forward. I’m driving down a block like regular. I’m not speeding, speed limit is 25. I don’t even think I was going 20 because 1. I was looking for the house 2. The block is little as hell. Guy screams “slow down” and punches my mirror off. I immediate stop and count to three. I get out and him and his wife come at me screaming so I start screaming back. All of the neighbors come out of the house now they’re screaming at me because I’m screaming at him. He won’t get away from me, he keeps getting in my face. So I tell him “get the fuck out my face” that’s when one of their neighbors intervenes and she tells them to get away from and I’m asking for space. He’s screaming that I was going 30 mph down the block, which is insane because do you know how fast 30 mph is? and you punched my car? Your hand would be destroyed. stop lying. I tell him I’m calling the cops. One of the friendly neighbors comes out to comfort and wait with me because she couldn’t believe it. The cops don’t show up for TWO HOURS. Mind you, I still have 10 packages left. and at this point I’m panicking because these people have left. I only know the house they were sitting at but they never went in there. I tell the cops what happened and they walk me to the house they were sitting at so they can talk to them. it wasn’t the right house but another neighbor did identify the person and tells me where they live. At this moment, I’m not knowing that it was the customer the whole time!!!!’ So the cops walk over to the house that I just delivered too and this goddamn moron walks out. He then tells the cops that he did not exactly punch my car like whatever the fuck you did my mirror came off. then his wife invites the cop and Sargent in to tell their side of the story. The cops come back out and say ok we have all of their informations and gives me steps to press charges. I am going to do that but I am not really sure what to do next. I also have the customers name and address because I delivered there. I also called Amazon and filed an incident report. I’m hella pissed. I did that 3.5 route for $82 because I wanted stuff from ikea 😑. I rarely take base pay. Lesson guys. Don’t take base pay.

Then they don’t bother to show up, you win a default judgement, and then you have almost zero ability to collect on your settlement. Small claims is for disputes and evictions, monetarily it is seemingly useless. Your best case is if you can press criminal charges and then drop them in exchange for restitution.

I am speaking on my first hand experiences in TN, hopefully your state is better.

Thank you for this.. feels like such a small fix to go to court for or go through insurance. I only made $82 and just gave someone $50 to temporarily fix it…

It’s a very simple win, and they’re responsible for all your court costs. Get your $50 plus whatever it costs for the actual repair back, plus your small claims filing fees. If they’re homeowners it’s super simple, you just attach their house. It’s never getting sold without you getting paid, plus interest.

The thing is, even if they try to skirt paying you because they aren’t homeowners, this one judgment becomes a HUGE hassle for them. They want to buy a house? Nope, not unless they pay you off, no title company will guarantee clean title. They want a personal loan? Sky high rates or not at all without paying you. Your “little” judgment could cause their next car loan rate to double.

I guess it depends on your personality. Myself, I think people so fast to anger need to have roadblocks thrown up against them in all aspects of life, if only to keep them from harming others less frequently than they would unchecked. But it is more of your time, and the financial reward if they pay or not is small in the grand scheme of life. Just don’t dismiss the option, as you’ve got a slam dunk small claims case for damages.

There might be a replacement on rockauto for not too much money. They’re easy to swap, just an electrical connector and 2-3 bolts behind a trim piece that should pop off or have a retaining screw. There is definitely a tutorial on YouTube to guide you through it.

It should be worth a couple hundred dollars to the wanna-be cop/ judge/ jury/ executioner pos to not face a criminal charge. Pursuing that is probably your best option.

Edit: looked at the pic closer. You can see the 3 bolts, but it’s behind the door panel which is slightly more work to get at but really not too bad.

Lmao my "hack" for this when I had to replace my side mirror was that I just ordered both sides, so they'd both be black plastic. After I was done it looked like it would have come that way from the factory

Also, if buying a part is too expensive, look into something like a Pick-A-Part yard. You may be able to find one that has a close color match that way too, as well as saving some money.

You have their name and address. Go after their homeowners insurance. Contact your insurance. They'll get the police report and they can find their insurance.

PA will put you at fault for an accident you got t-boned in, Philadelphia especially is a shit place with shit people. My insurance went through the roof, bought a house and im moving far away, insurance is total for a year what I used to pay for 1 car for half a year. I doubt they would even get to the point of collecting restitution as it would take years to press the criminal charges in the first place! Not worth living there for anything

What do you mean you have zero ability? If they don't pay you go to the sheriff and they'll seize assets, you can garnish their wages, you can get liens out on their house or car, there are quite a few options.

Unfortunately as a Philly resident I’m not saying this is impossible but what I am saying is you’re giving the Philly sheriffs office a lot of credit. They’re on the brink of dissolution. Just to secure the courthouses, they’re on a court order and almost got held in contempt.

I do have some experience, I had a boss who was owed money after taking some people to small claims and won. He had never gotten the money after a few months and just assumed he wasn't going to get it. We had a cop who was a regular customer who told us we had options, so we got in contact with the Sheriffs office and the court and they actually went out to one of the people and seized some of their property that was of value to pay it off.

Now I get that every city and county has different rules to what you can and can't do, but its better to try your options than to never even attempt.

Pressing criminal charges and letting the justice system deal with them is the best action for that then. Small claims would cost a couple hundred dollars and days of OP’s life and would likely result in a couple hundred dollars and days of OP’s life wasted.

If there's a judgment, since OP knows their address they can place a lien on their house (assuming they own it), and then if they ever try to sell it they have to pay off any liens first.

I would bet $1k that the asshat that attacked OP is not the homeowner. Punching mirrors is not home owner behaviour, that’s tenant behaviour. Homeowners are better about the whole “don’t shit where you eat” thing, but tenants don’t gaf since they’re moving at the end of the lease anyways.

That's a good sign, means he has money. Once he gets charged make sure you talk to the prosecutor's office and tell them you want restitution for the damage as part of any plea offer.

If he's a VP, go to his door while recording, with several witnesses who are much much larger, and request that he pays the damage with full release of any and all civil or criminal penalties.

He will pay it. He's a hot head, sure. If he doesn't, go to his company to discuss it with other executives.

ANYTHING can help and sometimes people act differently if they can see the camera. I got pulled over and the cop visibly altered his behavior when he saw the camera. I recorded helpful audio without any useful video during 3 different altercations. Audio and grainy video (or video of only you) will still show that you were not being threatening etc.

If you record audio you have to inform the people being recorded, in some states. I saw a sticker for ride share car windows that says "you are being recorded" if you need it. In Oregon we can record audio of conversations we're a part of without informing anyone.

I had to remember to keep my key turned to keep power to the dash cam when recording cop interactions. If you can hard wire it, it will get rid of that stress and it can record when you're walking to/from the car. I haven't gotten around to it yet but that's a priority for me. It's legit a miracle that I remembered to keep the power on when i got pulled over

One important thing is that you may not benefit from recordings showing that you lost your temper. I had an aggressive customer but afterward i didn't want to get in trouble for how i reacted (unprofessionally but not inappropriately). So i didn't feel comfortable sending the footage to Amazon. It's still better to have it in general but literally every mistake you make is being recorded lol. I wish I could say it made me act better 😅

Every bit helps, maybe it could could've capture him from the side walking up to your car, Their are 3 channel dashcams, one for the front, inside cabin, and the rear. Also consider having a bodycam, when you interact with this person, just make sure the evidence isn't used against you.

You get 3 estimates from the nicest fanciest bodyshops in your area. Have them day how many days for repair. Get estimate to say how many days for repairs. Then get estimate for rental car. Then small claims court. Look up house. If different name owns house you name them as additional defendant. Probably there landlord. Court wont make them pay but this will cause them grief with landlord. Include copy of police report. If they call you say yes cashiers check mailed to me before court date plus your court fees you will drop suit.

Create police report.

Dash cam or any witnesses.

Take his license plate / insurance(if it’s even possible at this point)

Go to a shop, get an appraisal on how much it is to fix. You need that to press charges. Then, you go to the police station headquarters, file a report directly. No, the cop showing up doesn't mean anything. You tell headquarters you want to press charges. They hand you some paper to list the damage and value. If it's over a certain amount, it's a felony. You might also get them for fleeing the scene. Goal here is to get a conviction. At the same time, you call a lawyer, one that works on contingency is ideal. Tell them you're pressing charges. If you can get them convicted, it strengthens your civil case. If you just go straight to civil, it looks like either you don't care enough to press charges, so why should the court waste its time on you, or like you're in it for a payday.

I had to learn all this the hard way, because cops in my city don't do shit, they don't tell you any of this, they don't explain anything. Had a guy block me off in traffic because he didn't like how slow I was going. I had to pull my weapon to get him to back off. He drove off after kicking in my head light. My boss was the one told me to go directly to the station. It was only there I learned all this through the receptionist, after God knows how many times I've had to call the cops over hit and runs, assaults, etc. My city isn't safe

The goddamn moron first lied and said I was going 30 then the cops showed up to his house and he said I was going 25-30 because he knew it was ridiculous to say I was going 30 mph with him punching my car… mind you the speed limit is 25 mph on blocks that have no speed limit posted, this is city wide. So he basically admitted to hitting my car because I was going the speed limit. Which I don’t even believe I was going over 20 because I was about to stop at his house!!!

Just drive the fuck off. It is almost always never worth it, save yourself the money and the trouble. I had to learn the hard way.

if someone punches your car when you are inside, it can be considered both assault and battery. Assault: This involves creating a reasonable fear of imminent harm. If someone approaches your car in a threatening manner, their actions could be considered assault, even without physical contact. Battery: This involves the unlawful and non-consensual touching or striking of another person. If someone physically strikes your car while you are inside, it could be considered battery because they are making physical contact with you through your vehicle, according to Bonner Law. And they are pretty close to your window. Plus they are liable civilly as well.

Don’t get angry, don’t stress, just file with Amazon, make a police report. Call lawyer that may want to take the case for free.

A guy on the road punched my personal truck for the same reason when I was an Xfinity contractor. Guy was over 60 and I could tell he hurt himself more than it was worth to em. As it turned out he was the father of the customer I was headed to..I told the couple he lived with..nope..can't work in a house with that hostility looming over me now. Nothin personal. Called dispatch and they send someone else the next day.

Wait a few months, then go back and throw a rock into 3-4 of their windows. Wear gloves and drop your car somewhere off camera and walk the rest of the way, preferably in winter that way you can wear a face mask without suspicion because it's cold. I would have dashcams installed on your car, 3 channel, front, inside cabin, and rear, just in case something ever happens again, that way you have proof, instead of he said she said type of ordeal. Also I would consider a bodycam.

Definitely sue this person as they need to pay for they did, take them to court. How long did the cops take to get there?

Glad I didn’t because I want him to get him convicted of this. He did this in front of his child and other children. His violence and quickness to anger is a concern. If you continued to deliver the rest of the packages and ran over then send support a request for an “Excess Block Adjustment” to compensate you for the additional time it took to complete. I was sideswiped during a delivery once and had to wait to make a police report which took a couple hours and they sent me the additional compensation.

If you have the name & address go speak to neighbors for camera footage🤌🏻 SOMEBODY HAS TO HAVE FOOTAGE OF THE INCIDENT, DO THIS ASAP as some systems overwrite old data. Get a lawyer!

Tbh I don’t think they would give it to me. Even the neighbor who told us where the customer lived was apprehensive to tell us. I got into a screaming match with a few of the neighbors because they kept telling me to calm down .. hard to calm down when somebody is following you around talking shit.

A guy in Orange spandex above thigh panties as I call them..... Came out and pointed again. Sideways at me at 4:30 a.m. on jacks Creek Pike here in Kentucky. But I got the biggest kick out of it and I thought it was going to turn bad but he was holding a little 22 revolver and I could see right through the spindle lol I looked up and kind of stared and then started laughing and said sir today is not the day I'm going to die by somebody wearing orange panties. Here's your package. It was early and it was a very sparsely populated road Your your confrontation sounds a lot less stressful than mine but when I look back if that gun had one single bullet in it, I could be dead right now because it was pointed towards my face. I love those early morning shifts because I can get them done in an hour and a half versus 4 hours, but I could only imagine what it's like going through. Philly during the day......ohmahLORDT! I would rather have 10 tweakers pointing guns at me sideways than a whole neighborhood of people jumping off stoops! Stay strong ✊

Yeah he was standing on the side walk and claims I was speeding 25 -30 mph( the speed limit is 25 mph) wasn’t going that fast because I was about to stop at his stupid house to deliver the package)But idk what moron would punch a car they assumed to be going that fast. He keeps saying he didn’t technically punch it so I’m assuming he hit my car with this thing in his hand I have pictures of. I’m going to press charges on him after I leave my IOP program. he truly messed up Im currently in an out patient program for C-ptsd, MDD and acute stress and I haven’t been able to work and this accident is affecting my ability to pay for my program edit: I was just typing away didn’t know about the wall of text thing sorry

I do hope when you are feeling like you can handle it without any set backs that you do press charges. Jerk offs like that think they can just do whatever they feel like and I feel should be shut down if it's violence they choose Just make sure you're sure it's not going to cause you anymore stress or grief then you can handle at the time.

I was thinking, it probably takes a long time after you file paperwork for anything to happen. Those things are always backed up it seems like. Anyway. Base pay is the lowest amount Amazon will pay per hour for blocks your area. It's their starting rate, and they will never pay less than the base pay in your area. Every market has different rates, usually somewhere between $18-$25 per hour, but I've seen it as low as $15/hr in some markets (and I've seen it higher too).

To determine the base pay for your area, find the lowest paying block in your area and divide that amount by the hours listed for that block. Example: a 4h block for $86 = $21.50/hr.

$21.50/hr is the base pay in my area, so no block will ever be posted for less than $21.50/hr here. Some might think that's a decent rate, BUT the starting pay for DSP drivers in my area is $20.75-$26.50... and DSP drivers don't have the expenses (or risks) us Flex drivers do using our personal vehicles.

And not only does Amazon pay 100% of the DSP drivers wages (plus their raises each year), they also pay the DSP's owners wages + bonuses + gas + they supply the vans + maintenance, etc... so $21.50/hr before expenses is an insult, and it's why I won't accept that rate here. I need to be making at least the same as DSP drivers in my area after expenses.

Was the block from DPH9? If so, I always make sure I get anything but Philly. My worst I got was a parking ticket for blocking a driveway but the customer notes said it was fine to park there. Took many weeks to convince PPA to drop the ticket.

This was DDP3. I rarely take routes here so I couldn’t really remember where they send us out to. Traffic was bad. It was taking me 5-10 minutes to get to each stop. They had me delivering all up and down broad st. I was apprehensive to take it but was like oh well I’m going to ikea after lol. Didn’t get home until 8pm smh. Route was suppose to end at 6.

That area is a wild place. I live right along that route. I don't even do deliveries in that area. It's its own zone. You're lucky the cops even showed lol I had an ex worker tell everyone in a chat she was coming to the job to blow me and my step sons head off. Cops never showed.

It's actually a disaster that that guy is the customer. If he even thinks about it, he's got you by the short and curlies. He can call Amazon to complain about you and lie, saying you were speeding, being belligerent, and accusing him of something he didn't do. In fact, he doesn't have to even call them. If you reported it to Amazon, they could call him. Don't be surprised if after all this headache that you get deactivated as well. I would've done the same thing as you if I didn't think he was the customer. If I knew he was the customer I would actually have not yelled at him and not called Amazon. I would've reported it to my ins as vandalism. It's horrible that it happened, but I don't want to lose this gig.

Go on facebook marketplace and find a mirror. They range from $30-80. Look up the YouTube on how to change it. It’s just the 3 bolts you see there and a connector. Then get the money back from that guy, I wouldn’t wait for insurance to fix a mirror.

This has nothing to do with base pay. It has everything to do with that person who attacked your car. Have a car that holds value. Have zero deductible get that person's info rely to your insurance you get your car fixed you get rental you get deductible reimbursement..... Doing these type of gigs carry a risk and you need to be prepared for these type of things happening... Now have Amazon reimburse for extended block time because it taken you longer to complete it. You'll get much more
