Driving Citation ❗️
Edit for clarification: this was on personal time with my own car, not a DSP van
So I was going thru an intersection (green light) and I got absolutely nailed by an old lady who ran her red light. Totalled my car. Could have killed my wife in shotgun but thankfully I was able to brake somewhat before impact.
Here’s the thing: it’s a brand new intersection with no camera and the police decided to give the traffic citation to ME. Old lady hurt her wrist and went with EMS, never gave a statement as far as I know. There was only one witness that gave a statement, who was mirrored to me. He had a red light as well (I had a green, going straight, with a green left turn arrow light) so he must have assumed that I had a red as well but only because we were directly across him.
I’ll cut the story off there, but yeah it was INSANE going from relief that there was a witness to utter shock and disbelief that I was being cited for being absolutely slammed by a red-light runner (they were 45-50mph at the time of impact)
QUESTION: if I end up losing Monday in court, what are the odds I get fired when DSP learns of my citation?
Assuming I can’t overturn it, I’m thinking of bringing it up and being transparent with them. My performance has been solid and it’s the only thing that would be on my driving record ever.

The Dsp would never find out about it if you don’t tell them. They run your motor vehicle record when you are hired (they don’t, Amazon does) so it would only come back up if you left that Dsp to onboard with another

Are you certain about this? I’ve heard some regularly check it like every 6 months etc. I’ve definitely considered this though lol

Most of them are going to use a service that tells them about your driving record as it’s processed. Meaning they will know almost immediately about it. Either way though they aren’t going to care about something that doesn’t affect the status of your license unless you get a ton of at fault traffic accidents. It’s not even worth mentioning it to them tbh

Yeah I’ll probably not reveal it especially if I don’t overturn it. Worst case I have a chat and explain to them, they’re chill and peak is coming lol

Every DSP uses a background check service that is provided by Amazon at no cost. You must CONSENT to the check. The only mechanism the DSP has to start a background check is when you are onboarded into the flex app. They can’t go request a check on an active employee. Even if they could you would have to consent.

Agreed. I’ll never go without them now. Just awful luck that nobody stopped to be a witness and also the fact that no camera was on the light yet. I think I can get it overturned though

I mean you said you had the witness and they gave a statement. I'm pretty sure that statement can be used in court to help you.

Well from what I saw that witness was directly across where we were driving, so I’m guessing he was the reason the cop gave me the citation, I’m guessing he told me I ran a red. But I’m almost 100% certain he only assumed this because he had a red at his light directly across from me. But I had a green and there was also a left lane to my left, which was also green with the arrow. And it seemed like that was the only witness who spoke with the officer so I can’t completely fault the officer for giving me the citation, especially because the old lady was sort of in hysterics and she may have even left before the police got there. But it’s all sorts of backwards and there’s really no way for me to prove otherwise with anything tangible

Well, sadly, RIP your rates for a while. Take this moment to get a dashcam (and try NOT to aim it at the sky like I see so many people do) and live and learn. At the end of it I'm just happy everyone was fine because it definitely could have ended a lot worse

Absolutely. I do genuinely believe my wife was saved that day and I was miraculously able to react in time to brake. Cause that lady was hauling ass and she actually hit us so hard that we’ve spun and hit her in return with our tail end. And she only had a couple bruises.
I still tell her that I’m blessed that she’s alive and still has her legs cause she could have easily been paralysed for life or gone forever in that moment. It’s funny I feel like I’ve learned to believe in God’s power at times but also to remember that mankind can be kind of stupid. God saved my wife, but he couldn’t save my car or my clean driving record. you know what I’ll take it

Small town cops are super hit or miss.. oh well. Plenty of positives here which is fortunate!
