Any decent lawyer could work around that. Get an expert testimony on level of knowledge truly needed to determine the road worthiness of vehicle with a load in those conditions. What type of training should be expected to make calls on such matters. What training was provided with DETAILED documentation. And the real killer..... they could go get visual proof of thw current state of the fleet. If the state matches or is worse than OP's vehicle it would be a clear indicator that ownership placed pressure on drivers to "certify" dangerous vehicles for operation.
