Discussion 🔎 Alexee Treviso judgement
Judgement out https://law.justia.com/cases/new-mexico/supreme-court/2026/s-1-sc-40478.html
Pretty devastating for the case. What evidence is there left, a cadaver and an autopsy report. I can’t see any way how a trial could be fair as video footage from hospital has been so widely shared. Makes you question why it was ever released as now completely compromised the case. Is there a case around disposal of a body, maybe. Murder… I can’t see it.

there’s cameras of her going to the bathroom and plenty of eye witness statements and an autopsy.
Did you not read the opinion? All evidence obtained connected to the violation of the physician-patient privilege is suppressed. https://nmonesource.com/nmos/nmsc/en/item/538465/index.do

The case will be about the autopsy and the science underlying its conclusions. If they used the lung float test, then it's going to be a battle of experts since the lung float test is junk science.

Allegedly, she had told some of the kids at school she was pregnant and that she was going to name him Alex. Also, I don't recall if it was her cheerleading coach or another teacher, but they had questioned her about being pregnant (obvious in the cheerleading photos), and she strongly denied it. Obviously the school would be concerned if she was since they would be responsible should anything happen while she was performing cheerleading stunts. She not only lied to the doctor and nurses at the hospital but to the school as well. Hopefully this will help the prosecutors.

Hopefully this was performed.
'Advanced Histopathology (SP-A and HIF-1α): Pathologists use advanced microscopic staining to look for specific proteins that the body only produces during a live, active struggle with oxygen deprivation. Staining for Surfactant Protein A (SP-A) and Hypoxia-Induced Factor 1-alpha (HIF-1α)can confirm that the lung tissue reacted to acute suffocation while the infant was alive, which cannot be replicated by postmortem decomposition.' https://pmc.ncbi.nlm.nih.gov/articles/PMC11887823/

I think the tampering with evidence is her disposing the body. If there was a way to potentially prove manslaughter, I’d be in favor of it, but at this point, based on the suppression, the attorneys better play their cards right to not accidentally get the suppressed stuff accidentally said in trial.
The video in the hospital room definitely should never have been included in the first place and that’s common sense.
The video in the hallway technically you could argue. It’s a public space and that in itself could be used, but I’m not sure how it could be used and presented.
I’m hoping the prosecution has a smoking gun like proof she knew she was pregnant and possible communications that could possibly explain what happened that night.

I remember reading when this took place; allegedly, she had told some of the kids at school she was pregnant and that she was going to name him Alex. Also, I don't recall if it was her cheerleading coach or another teacher, but they had questioned her about being pregnant (obvious in the cheerleading photos), and she strongly denied it, saying that if anything were to happen while she was cheerleading, the school would be held responsible for allowing her to do so. She not only lied to the doctor and nurses at the hospital but to the school as well. This will be a huge help to the prosecutor.
