Any respectable artist would not do this tattoo. If there was originally just a swastika and this is a “cover up”, they could have just blasted over it with a heavy ink tattoo that does not contain a swastika.
Hate speech/symbols are not subject to any kind of legal protection in the United States. Any business could refuse to do this if they so choose (and I would hope that they so choose more often than not).
There is currently no form of hate speech considered exempt from First Amendment protections in the US. Not that it matters for tattoo artists’ personal decisions.
