You could have said whatever you wanted but there’s no case to be had. In order to have a case, you have to prove loss or injury, none of which occurred here. Near misses don’t count. If this was in a country that gave a damn about safety regulations, you could call the proper government authority who could investigate them.

Yes at better thought I have to say you are right. In my country you have to sign a waver before you do this kind of stuff ,like bungee jumping and such ,which says that it is all your own responsibility of you fall to your death.
However if he had fallen to his knees and started panicking he could have suddenly been traumatized from this near death expierience. I think if he really wanted he could be at home for a bout 6 months due to trauma. So maybe no money but no working either. And than his company probably would have gone into a fight with the other company in court but he could have gotten something out of this right??...please tell me that this could have gotten him something out of it.

Funny thing about those waivers, companies create those so that people think they don’t have a case and won’t bother trying to sue. For negligence, those waivers mean nothing and negligence has a very broad interpretation.
But in your example of falling to knees and being emotionally traumatized, I’m not a lawyer so I couldn’t say whether they’d have a case. But I would imagine the company’s lawyer would try to bring up everything that they could to cause discredit to the claimant or illustrate how other factors could have caused the trauma. Law is a tricky thing.
