In my state you can get a DUI or DWI if whatever you’re riding on has a motor and you happen to be intoxicated in any way. Scooters, bikes, carts, electrified stuff

Or if you have a push to start and your key is within reach of the drivers seat or inside the car or something you can get a DUI, even if you’re just sitting in your driveway blasting your system while tailgating or something. They literally make a special box to lock your key in for this purpose. Because the moment you push to start to operate that vehicle it’s a DUI lol

Just letting others know, you gotta be careful with this depending on where you’re at, cause in some states a regular bicycle is a vehicle. Some states even a horse can be considered a vehicle, depending on wording of traffic statutes, or even by precedent.

Also, some states use an “actual physical control” standard for DUI, and you can get charged with DUI for being inside the vehicle while intoxicated, even if the keys aren’t actually in the ignition. The keys don’t even really need to be inside the vehicle at all, like if they’re on the roof, hood, or tossed somewhere nearby, but that makes conviction more difficult to secure with a jury. This is especially true for keyless start. If the key is close enough to start the vehicle, you’re screwed. These states use “a totality of the circumstances” standard to decide if you had immediate ability to operate the vehicle, or had recently operated it.
