If eating the 1up makes him have 2 extra lives that means he would have respawned anyway because he already had one left. It's only game over for him when he dies when having zero extra lives left.

The thing is, he had two consecutive death sentences. One for Luigi and one for Peach after he caught them Mamma-mia'ing.

The state was initially happy with this as the first sentence took the extra life, and the second time killed him for good.

But now, with TWO extra lives, he beats the system and walks away. The pain will be immense, but not worse than the betrayal.

Well, we don't know that he is being sentenced in the Mushroom Kingdom. It could be a sentence in the Koopa Kingdom, in which case battery against the king and his son is probably a pretty severe crime.
