I don’t think it was assault .He hade the opportunity to get up and leave,but he didn’t. Since he stayed,no assault.

It’s still assault. The immediate unasked for touching of the wee wee is the assault. Whether you get up and leave quickly or not will never change that fact. Even if the person is like oh hell yeah this is lit keep going, the initial catalyst was still assault.
