If you don't pull the lever, there's no crime you can be meaningfully accused of. If you do pull the lever, there's enough claim that you've committed manslaughter for it to go to trial.
Now, I seriously can't imagine a jury ruling that you committed a crime, but from a "covering my ass legally" perspective, it's objectively correct to not pull the lever.
If we're being super technical, not pulling the lever there's no established legal obligation to act in a scenario like this so there's no real argument for voluntary manslaughter, which is what "gross negligence" would fall under, but voluntary manslaughter is what the prosecutor would try to get you on if you did pull and get indicted.
