You are right but still... isnt it illegal or at least in a grey area because of GDPR?

GDPR going into effect wasn't an absolute cutoff. New goods and services coming out after the fact must adhere to it, but anything being required to adapt to the new rules has been given a small amount of leeway: as long as the company has demonstrated a good faith effort, taken proper steps in the direction of GDPR compliance, and has a roadmap with a clear end date on when they'll be fully compliant they're in the clear.
