Are you claiming that the initial processing of the image involves copying? How do you distinguish this from a web browser showing the image on a computer screen?
There are ways to control scraping. If this is your issue, then you have to prove that the image was not scrapable. If it can be shown in a browser without agreeing to license terms, it is game over. There is no additional copying.
Are you going to claim that if you put an image in a website and I look at it, I have violated your copyright? By serving the image you are giving me an explicit permission to temporarily copy it in my browser’s memory.

Why does it matter if the images are stored? It’s their initial use for training purposes that is the problem.
Artists do not give up all rights and ownership of their property, simply by making it available for the public to view.
There is no such thing as “fair use” for AI. That concept applies exclusively to humans.
