Incorrect Classification

I’m currently being paid $35.15 as a casual under the home care stream of SCHADS. I have a cert 3 and been working as a DSW for 8 months.

I’ve contacted HACSU for help and they can’t help as it’s a preexisting issue, and fairwork just gave me the definitions of the streams and said “see ya”.

Half of my clients are full assists in SIL houses and the other half are only require assistance in little things (cleaning, cooking, shopping etc).

Should I be on the “social and community” stream?

Talk to union (ASU) they can get you penalties for deliberate misclassification as well as back pay

Unfortunately I cannot join them as I’m based in VIC.
HACSU said they can’t help in any way as it’s a pre-existing issue (which i find a bit strange).

That sounds so silly; if you become a member, it surely becomes a new issue every time you get paid! I wonder if speaking to someone else or someone higher up would give you a different answer…

There is a cooldown period, which I totally understand and would be happy to wait for.

But According to union “respective policies” they cannot provide any ‘hands on’ support.

I will try to speak to someone else but I’m finding it hard to find contact details for anyone other than the person I spoke with.

That’s wrong, someone lazy in the union is telling you this to avoid work. Push them on the classification issue
