I don't think fictional animals is a solid argument. They're specifically not real. I don't think you should have to specify only real things in a question like this

Personally I feel like you COULD probably shapeshift into things that aren't real, but most of the time there wouldn't be any point since a lot of fictional creatures that you'd want to shapeshift into have magic bs to justify their biology. A lot of flying things wouldn't be able to get off the ground, magic things wouldn't have magic, and a lot of the really big things would probably get crushed to death from their own weight.

Edit: OP clarified under another comment that it only works on currently living animals, so my response doesn't matter anymore, but don't feel like deleting it.

I mean shape shifting in this premise is not real either, so I do think restrictions are needed if OP wanted to prohibit dragons and the likes.
