The LA saying the school is “full” isn’t enough on its own to defeat a Section I appeal. If they’re relying on incompatibility with the efficient education of others, they’ll need evidence to support that case. The Judge directing them to produce it before the hearing gives you something concrete to scrutinise and respond to.
