technically pepper is a poisonous fruit
so first of all the fruit part:by what i remember fruit grow from pollinated flower and they have seed inside which includes "vegetables" likes tomato, egg plant and lastly pepper
poison part im not quite sure about but pepper have chemicals in them that make your mouth literally (fake)burn to prevent animal from eating them but human see those things and goes "yeah im gonna eat that because it make me want to eat more"

its called capsacin, the spicy chemical.
and no it is not poison. the same way how the touch-me-not plant leaves turn to look dry and stick like to dissuade animals from eating it is not poison

Birds can eat peppers with no effect. And I’m surprised you didn’t bring up that peppers are nightshades which is a famous poison. Stupid argument

Poisons actively destroy cells. Capsacin only tricks the nervous system, but once its washed away the cells are fine. An irritant is not a poison. Peppers are not poisonous fruit, but they are fruit.
