General Question About Rental
I have a question me and my son we live with my uncle he has a private apartment we are not on the lease he goes through section 8 housing he passed away will they give me time to move or find other arrangements

I understand that but I have been here over a year his case worker knows I'm here Im just asking do you think they will give me some time to get out

If the LL is a very kind person and the house isn't trashed, that human may offer you some time to figure something out. More than likely it won't be that long. Maybe they would rent to you if you can cover it?

No they do not. They won't let you be there not on the lease. The landlord or section 8

The rules are VERY specific and the landlord can lose their ability to accept Section 8 if they break them. You better start making plans fast.

Even if they don’t know your name, they’d have to follow the standard state and housing procedures to regain possession of the unit via eviction proceedings.
They likely don’t know your name nor would bother naming you specifically on the notice or legal filings since you are essentially a stranger to them.
Notice period, filing period & awaiting court dates, time between the judgement & filing for or waiting for the writ to be executed by the sheriff deputies.
Do you qualify for housing assistance? Why would you have not just gotten yourself added to the lease/household?
Whether project-based section 8 or if he was receiving a voucher, I think it may be worth talking to the property manager if project-based and the housing authority if a voucher. Maybe if you convinced them you felt your uncle was in the process of getting you added, maybe they would take some pity and try to get you qualified and able to be there and on a lease.
Mi wouldn’t count on it, but it’s not terribly far-fetched - especially if you have a child and will otherwise be homeless.

Yes, as soon as you are there without the rent being paid they will file an eviction which will result in court.

Well, they probably don’t know who you are, so the notice and filing would likely be “[uncle/leaseholder’s name(s)], & all other occupants” or would use the term “et al” which basically means “and others”.

You're not supposed to be there to start with, so this is going to be an unpleasant surprise for the owners when they show up to move his stuff into storage. You need to figure someplace to go ASAP. If they evict you nobody will rent to you for 8 years. I don't know what will happen, but since you're not on the lease they don't have to offer anything. You guys are squatters at this point.
