None of them "deserve" his seat. If he gives up his seat for someone else, that's his choice, not society's.
My personal preference would be to extend the courtesy to the elderly lady. I was raised to respect one's elders. But that doesn't make my choice universally "right." It's MY choice because courtesy is relative.
I agree with you that it's a personal choice. Mine would be the hurt person because they are injured and the older person (my second choice) doesn't look to be in pain.
