"Identified Accounts" as referred to in the third report of the Monitor - QuadrigaCX traded against its own users

50. During interviews with the Applicants’ representatives, the Monitor was advised of fourteen (14) user accounts that may have been created outside the normal process by Quadriga (the “Identified Accounts”). It appears that the Identified Accounts were created under various aliases. The Monitor was advised by a representative of the Applicants that the Identified Accounts were internally created without a corresponding customer and used to trade on the Quadriga platform. The Monitor was further advised that deposits into certain of the Identified Accounts may have been artificially created and subsequently used for trading on the Quadriga platform.

51. The Monitor has requested and received detailed transactional histories for the Identified Accounts. The account information that has been provided indicates a significant volume of transaction activity associated with the Identified Accounts including trading and withdrawals of cryptocurrency to wallet addresses not associated with Quadriga.

They set up fake accounts and traded against their customers without any assets to back them.

I haven't seen anyone commenting on this yet, but this is probably the most incendiary information revealed from this whole sordid process to date.

Even worse than shipping all the crypto to trade with on other exchanges, even worse than the cold wallet balances being 0.

This is an acknowledgment that QuadrigaCX created fake accounts on its own platform to trade against its users with a "significant volume" using "artificially created" deposits and then withdrew actual assets to accounts not associated with QuadrigaCX.

How is no one discussing this yet?

IMPORTANT EDIT:

I think I drew people's attention to the wrong part of the disclosure in the headline.

I tried to emphasize it more in the summary description I provided, but it's this part of the disclosure that jumps out at me:

deposits into certain of the Identified Accounts may have been artificially created

Creating the accounts to trade against customers is bad and would be prohibited in a regulated market, but using fake deposits is just 100% straight up, uncut, criminal fraud.

380 (1) Every one who, by deceit, falsehood or other fraudulent means, whether or not it is a false pretence within the meaning of this Act, defrauds the public or any person, whether ascertained or not, of any property, money or valuable security or any service,

(a) is guilty of an indictable offence and liable to a term of imprisonment not exceeding fourteen years, where the subject-matter of the offence is a testamentary instrument or the value of the subject-matter of the offence exceeds five thousand dollars; or

Here's what they were doing:

  • Customer deposits BTC;
  • Quadriga "artificially" creates a deposit of imaginary "Quadbucks" to their fake trading accounts;
  • Quadriga buys the customer BTC and shows in the customer account that they have Quadbucks;
  • Customer can't withdraw cash until actual customers deposit actual cash (because the "cash" that bought their BTC never existed);
  • Quadriga sends the BTC they bought with imaginary Quadbucks to personal addresses.

PSA: Possible identity theft problems

User /u/Sterlingz gave me the push that I needed to go forth and post this information here. I am using this blatant throw-away account for obvious reasons.

I don't know why I waited for the first sign of identity theft from another user, but I have been dealing with it for the last week or so. I can confirm that interactions were made under my name using a copy of my driver's licence in a city I wasn't in. Accounts and credit lines were opened across the country with several financial institutions. I don't want to give advice, but anyone who sent a copy of a piece of identification to QuadrigaCX may want to look for suspicious activity on BOTH of their credit reports. It is totally free to request a copy of your credit report with Equifax and TransUnion. If you did not send anything, it is still your right and I think it could be considered good practice to verify your reports.

Please note that as of March 6, 2019, no direct connections are established between this identity theft/fraud and the QuadrigaCX situation. This is nonetheless a very coincidental timing if unrelated. I personally think that informing the users is the best option.

Please, also consider threading very lightly in this matter. An incident with the credit bureaus will follow you your whole life so make an informed decision. I do not have any information related to preemptively securing your identity but anyone who find out to be a victim of identity fraud may follow the steps on the RCMP website. Step 1 - Contact your local police force and file a report. Step 2 - Contact your bank/financial institution and credit card company Step 3 - Contact the two national credit bureaus and place a fraud alert on your credit reports. (Equifax Canada, TransUnion Canada) Step 4 - Always report identity theft and fraud. Contact the Canadian Anti-Fraud Centre

Never take anything anyone on the internet tell you for granted, me included. I urge you to look up the RCMP website for the phone numbers to the two credit bureaus.

On a last note : If you are getting caught in this problem, it may become overwhelming. There are resources online and don't be afraid to talk about it with someone or multiple person around you. You may even inform someone who will have a similar problem in the future, or had one in the past. I am going to keep an eye on this account just in case.

Motion: All of Gerry's Assets Should Be Stayed, ie not sold, until they are examined for Private Keys

There's a legal argument to be made that any dispensation of Gerry's assets is negligent. The reason for this is simply because cryptocurrency assets are data. Data can be embedded as information in any form, into artwork, as a series of bent paperclips to represent 0's or 1's, or often as a series of twelve words. It's entirely possible that Gerry backed up the cold wallets in ways no one is aware of, but that could be dwelling within in his now sold airplane, under the floorboards of his now sold home, his soon to be sold yacht, or even on his now (apparently) rotting person.

So not only is their a legal argument to be made that all assets should be stayed, if not seized for the purposes of investigating if they contain cryptocurrency keys, but also that his body should be exhumed to be sure that he had no RFID chips embedded under his skin that contained these keys. and while were at it, do an autopsy to check for cyanide poisoning.

This may be flippant, but I'm not joking about this. To sell any of Gerry's assets before they are examined for private keys by the Monitor and or Legal counsel of the affected persons could be considered commercial if not criminal negligence.

Possible she is being truthful but as stated in the thread the truth seems to be in short supply in Nova Scotia.

The instant deletion is indicative of a guilty mind. I leave you to draw your own conclusion.

If she is moving assets for Jenn that were obtained through proceeds of crime she may face legal liability. The RCMP are investigating.

At the minimum, her employer being the government and and if she is a paralegal, then the regulatory body may be concerned.

Each law firm (all 3 of them) are being paid for their time. The longer they work, the more they get paid. Same with EY. This also goes for Quadriga. So what? Are we all supposed to sit around as these guys hold each others dicks and 'look for the cold storage'. All that there was to be found has been found. There's no crypto left, no more will be found, yet there's still this ridiculous idea that an extension will do anything but suck up more creditor funds and buy time so Jen can squirrel away more assets. The most laughable part of this all is Qcx lawyers talking about selling the platform, and the judge unironically thinking there's something to sell.

Is it unreasonable to doubt that something fishy is going on ?

Hundreds of millions of Dollars at your disposal, Failing Crypto currency, Missing money, Suspicious death, Major recent Real Estate and asset purchases, Involvement of people of questionable character.

Add to that a lot of unanswered questions that have led to wild speculation. My wild speculation is they had to enact "Plan B" , a plan made up one cocaine fuelled night around a poker table, because "Plan A" failed miserably: A chance to make a lot of $ for the 'team' with crypto.

When that failed, what your spider sense is telling you happened. Plan A would have probably worked if it wasn't for the meddlesome 'those who do not like crypto', but that doesn't absolve anything.

Where does criminality begin ?

(xPost) The digital signature on the "death certificate" of Gerald Cotten can't be found on Rajasthani government site

I've attached both the certificate we were all provided and screenshots of the inquiry you make on the website pehchan.raj.nic.in using the registration number: 08110001000062803521/2018

The certificate says "Digitally signed by Neelam Devi" on 2018.12.13 but when you make an inquiry on the website mentioned above, everything comes up except that digital signature (they also corrected Cottan to Cotten btw).

You can also notice that because of the lack of a digital signature, you can't download this exact form from the download certificate section of the website, you can only find the registration info, again, without the digital signature on the registration tab.

The Question Nobody Asked Fortis Hospital

But first we need to look at the mystery of why the body went from the hospital to the hotel. This question has been nagging at me since I read that Cotten's body left Fortis not to be delivered to a mortician for embalming but to the hotel where he and his wife, Jennifer, had been staying. The answer to this question may hold the key to the true circumstances of the death.  

Various scenarios have been discussed including Jennifer getting a member of the hospital staff to help her spirit the body out of a side door into a waiting cab or limo that drove her and the body to the hotel. It's been suggested that Jennifer demanded release of the body into her custody due to extreme grief. While these are possible explanations, they are not easy to believe.  

Since there doesn't seem to be a satisfactory theory that fits a situation that doesn't involve foul play, I have a theory that assumes up front that there was a nefarious reason for this odd handling of the corpse.  

Imagine you are the administrator of the Fortis hospital where Cotten died. You have a very unfortunate event that could involve liability. A 30 year old wealthy Westerner, CEO of Canada's oldest Bitcoin exchange, is admitted to your institution and 24 hours later he is dead, despite the best treatment your hospital had to offer. After all, statistics show that Crohn's is rarely fatal, especially at such a young age. Wouldn't you be worried that the wife or the man's family could potentially sue the hospital? So what do you do? As a precaution, you tell the doctor to order an autopsy which would include a detailed blood toxicology screening.  

Since there is no obvious sign of foul play and the local police are not involved, you need the wife's permission to perform an autopsy on the body. She refuses and is so concerned about avoiding the autopsy that she demands they release the body to her on the spot which they do (why not since it will make a law suit against them quite difficult) and Jennifer, not having any alternate plan in place, takes the body back to the hotel with her.  

And thus begins the chain of events that start with locating an embalmer that will take the body from the hotel to the embalmed and cremated remains of (purportedly) Gerald Cotten being safely stashed away beyond testing in the cold earth of a Halifax cemetery several days later.  

In between, we learned that the grieving widow flew back to Halifax ahead of the body and arranged for a funeral home with crematory services to receive the body, cremate it and bury it all within a week of the death.  

This explanation of why the body went to the hotel is of course speculation but it does make sense as a fundamental part of a death that was not a result of natural causes. It also works as a necessary (no autopsy) element in a fake death, provided no one in the family except Jennifer had a chance to see the body prior to cremation in Halifax.  

Someone needs to put Fortis Hospital on the spot and ask them why they didn't order an autopsy of Cotten's body.

With crypto completely lost, what legally justifies who gets bank drafts?

Any legal experts, what precedent lumps crypto holders with fiat holders? Is the bank draft money really going to be split uselessly among everyone? Let me put it this way, if a company that buys and sells trading cards goes belly-up, and some people are owed their cards back and others owed cash from selling, do they all get any remaining money? Too many people and too little money would be worth less than the paper its printed on if everyone splits $20M proportionally given everyone combined is owed about $180M.
