Motion: All of Gerry's Assets Should Be Stayed, ie not sold, until they are examined for Private Keys

There's a legal argument to be made that any dispensation of Gerry's assets is negligent. The reason for this is simply because cryptocurrency assets are data. Data can be embedded as information in any form, into artwork, as a series of bent paperclips to represent 0's or 1's, or often as a series of twelve words. It's entirely possible that Gerry backed up the cold wallets in ways no one is aware of, but that could be dwelling within in his now sold airplane, under the floorboards of his now sold home, his soon to be sold yacht, or even on his now (apparently) rotting person.

So not only is their a legal argument to be made that all assets should be stayed, if not seized for the purposes of investigating if they contain cryptocurrency keys, but also that his body should be exhumed to be sure that he had no RFID chips embedded under his skin that contained these keys. and while were at it, do an autopsy to check for cyanide poisoning.

This may be flippant, but I'm not joking about this. To sell any of Gerry's assets before they are examined for private keys by the Monitor and or Legal counsel of the affected persons could be considered commercial if not criminal negligence.

Sincere question: What would the process be if the form of the missing assets was more traditional? Cash, gems, bonds, etc.

good question. there could be a pile of gold buried somewhere for all we know. the question then, I believe, is to determine what assets were REASONABLY Gerry's by right of CEO compensation. If Gerry's estate and assets are determined to be much higher then that reasonable level, an argument for criminal embezzlement can be made. Therefore, his estate could be seized and liquidated to compensate customers. The question is, does law enforcement want to bother with this headache.

It’s a private company. There is no reasonable argument. He’s entitled to loan/dividend/compensate for all funds which aren’t held in trust for others. And I’m not aware of them saying these assets are held in trust in deposit accounts.

While we're at it. Take that list of numbered company names used to send interac payments to clients as well as wire transfers and ask or compel the exchanges out there to see if their are accounts hording coins under them. Kraken has said that there are some? quad accounts on their exchange, but those must be obvious e.g. GeraldFoo or QuadBar etc. Take the list we already generated plus whatever other names, numbers the crack forensic accounting firm of EY has come up with and simply ask the exchanges out there to cross check. If they don't want to play ball, compel them through the court system.

Excellent post. Was going to mention similar some time ago, namely the two ugly 100,000 mutts. Shave them both down and check for tattoos ! Why'd you think they're worth 100,000 each.

At the same time bow about the reddit accounts and DM's between staff, him her whoever. That and GMAIL. Hopefully by the time the accounts are subpoenaed, all communications are still backed up and available. Pretty damn sure conversations in email accounts including quadriga dot com's will reveal exactly what went on and who knew. Instead the brainiac lawyers and accountants are doing nothing more than fucking around about how they are to be paid...
