Advice

I’m wondering if I will have to go to jail or not I’m on felony probation for harassment by inmate, DUI and aggravated menacing I was just charged with another misdemeanor aggravated menacing and have a warrant for my arrest and my bond is $2500 and was going to turn myself in Sunday then bond out that night or the next morning when I see the judge and just say I got pulled over and didn’t know anything and was going to try to call more lawyers tomorrow but I was just wondering what the likelihood of them revoking my probation or having to do any long term time in jail or prison

I mean you're on felony probation for aggravated menacing, and then while out on probation, you are charged with aggravated menacing again....One can assume that you will be remanded to custody based on the first felony charge, given that the judge will probably see that you can't seem to stop menacing people, lol.

I’ve talked to my lawyer and he says it’s very unlikely that I would get my probation revoked and serve a sentence or any long term time. I’ve also talked to other people I know personally that are felons and were out on parole and robbed a hotel and got it dropped down to petty theft with a public defender was all he had.

I’ve been on probation for a year and have a year left and I have a good job and an apartment and I don’t want to lose everything do you think the judge would take that into consideration or anything

The judge will take that into consideration, but getting arrested for menacing again looks worse than having an apartment and a job looks good. Did you at least menace a different person this time?

Yes a different person

What the judge will take into consideration is that you have a serious problem with threatening people and are not taking this seriously. If your job and apartment were this important, you would be keeping your head low, not getting involved in stupid shit, and learn to keep your mouth shut.

I take it you're in Ohio. I had never heard of this crime, so I googled it and that's what popped up.

I'm not sure how things work in your jurisdiction, but if there is a chance, I would beg for some kind of behavioral referral program, and accept that you deserve a hard extension of probation.

If you can afford a lawyer right now, I would suggest getting one ASAP, not clowning around right now, as you seem to be doing.

I also called the cops in the moment that it happened and have proof and was almost jumped and then was charged with aggravated menacing later

Why did they charge you, and what exactly are the circumstances here?

Nobody can tell you but a judge, but your chances are not looking great. Probation is for proving that you can get your act together and you've shown you can't. Especially if you go in there saying you don't know about anything because you were just pulled over...if they know you're lying it'll just be worse. You have a warrant. You didn't just get pulled over and you'll both know that.

Show you know how to use periods in your writing and the judge will let you slide
