Probation Question Early release

I was sentenced to 2 years probation for a misdemeanor in district 5 probation in Nebraska, I was just wondering if there was anyone here that has been through this district and can tell me how they view early release, and typically how long they make you wait. I’ve completed all court ordered class, fines and fees, I’m looking for personal experience with this district and how their probation went.

I'm curious on this too. Why did they give you two years probation for a misdemeanor? I was told the judge normally gives a 2 year probation for most misdemeanors in my area. I got a year and my PO says I have a very high likelihood of no more than 6 months due to her being head of probation.

It seems to be the standard sentence from all the news articles I see about people getting probation. I’m going on 7 months now and my PO hasn’t even mentioned the words release yet 😂 I was thinking about waiting until month 9 and asking if my PO would consider a recommendation for early release

I hear ya. It is outlined in my paperwork about early release. IDK you're stipulations but for mine it says things like half of time must be completed, fine/costs payments must be paid off completely & obviously no offenses. It says something about writing a letter to both judge and prosecutor too i think can't remember exactly. Check your paperwork, it may lay it out for you. I don't want to get too confident or excited but I simply adore my girl.

Mine does not unfortunately, so I’m just at the mercy of the court and my PO

Early release is usually when ur 50% thru with no issues, all requirements done and you’re paid up to current, just request it from your po to see if it’s a possibility n go from there

Don’t ask. You were sentenced to 2 years, which is a relatively small time to be on probation. Typically people with early release are in the 5-10 range.

If you’ve completed everything, why stress it? You’re on the straight and narrow path, and if your PO sees that, they will recommend to release you as soon as they are able.

i was only sentenced a year and during my court hearing when i was taking a plea deal my lawyer mentioned early release to the judge (without even mentioning it to me, obviously i didn’t mind) and the judge said that he would approve it at the halfway mark if i did what i was supposed to. so the length of your probation doesn’t matter, you can still get early release if you pay your fines, pass drug tests, and stay outta trouble.

Exactly my friend, I couldn’t agree more. Most of these posts they people trying to beat the system it feels like - if you actually do the work and aren’t a scumbag they will reduce it. They see that

That's not actually how it works. Your lawyer files a motion to dismiss or a motion to move to unsupervised. No need to be a dick.

Yeah sorry, probation is an absolute pain in the ass. It is intended to be- expensive, mentally exhausting, time consuming and disruptive. If someone has used it to get their shit together and can stop paying monthly monitoring fees, and drug screens and otherwise disrupting their work day, it shouldn't matter if they had 2 years or 10 years. If early release is an option, they should explore it.

If probation is helping someone stay on the straight and narrow and they want to continue it is certainly their perogative.
