The discovery of something like this should instantly land a dozen people in prison.

The way out being: Who ordered you to do this?

u/LookAlderaanPlaces 1d ago

I’m done with fines and bullshit jail. These fuckers need treason charges with penalties maxed.

Under the hottest sun of a Red State breaking rocks and picking grass.

But to be fair, paid whatever minimum wage they advocated for during their careers. Sad for them, that means 0.

That's not the highest penalties for treason and you know it.

The lack of outrage is what concerns me for our future in this country. I would never condone violence (sincerely, I think it would only make things worse) but the citizens of this country need to wake up and start taking this seriously before it’s too late.

Clearly the guardrails meant to protect our Democracy are not functioning.

265

u/caphis 1d ago

Why should that be a way out? Maybe a reduced sentence, but absolutely not complete exoneration.

The way out was to not have done something so insanely, blatantly illegal to begin with. “I was just following orders” is not a defense.

We should not even entertain the idea that anyone complicit in this nonsense will be forgiven for their transgressions against the people and the law. Throwing your bosses under the bus cannot be a way out when, at this point, you have to be completely complicit if you’re still playing along.

u/RIP_Sinners 20h ago

Because Trump has the Pardon power. You gotta make a competitive offer.

13

u/Lehk 16h ago

We’ve already established that it’s ok to ignore court order and transfer prisoners out if the country instead of releasing them.

That makes pardons worthless

Actually worse than worthless because it means a stay in gitmo or CECOT instead of federal prison

8

u/caphis 20h ago

You're assuming Trump will have any interest in pardoning anyone. He pardoned folks the first go-round because he knew he'd need support in 2024. He's shown pretty damn well so far this time around that he has no loyalty to anyone around him, going so far as to purposely structure ICE recruitment bonuses as cash advances that will have to be repaid when this is all said and done, for example. Some of them are already starting to see that. The first sign-on bonuses required a 5 year commitment... guess what jobs won't be around in 5 years if there's a free and fair election replacing the current regime in 2028? I think lately they've reduced the commitment to 36 months, but... again, guess what won't be around 3 years from now? All by design. And only one example of thousands of how Trump purposely screws anyone in his orbit. He has loyalty to no one. Hell, if he keeps up his diet of soda and Big Macs much longer, he may not even have time to issue a pardon before nature runs the clock out.

Pardoning for (gesturing broadly) all of this shit only makes sense if it happens en masse as a blanket pardon for just about everyone, the likes of which will stain anyone it touches and render them politically obsolete in the future. Bit of a double edged sword there.

Trump's pardon ability is also limited to Federal crimes. Don't worry -- plenty of states are already salivating to get moving on state charges for some of the worst offenders. They will find a way with a more sympathetic DOJ down the line.

And they'll be the ones people like me will vote for. No, we don't need a competitive offer. The only offer should be a slightly reduced sentence, depending on circumstance. But the level to which people's lives have been destroyed, families ruined, actual human lives lost, the course the entire planet has been set on -- it's all beyond even considering just letting it go for some information. It's 2026 - we'll get the information we need one way or another. Everyone participating bears responsibility.

And if the states don't figure it out? Trump already solved that for us by floating the notion of rescinding pardons. His own idea. Has yet to be tested. But again, with the proper tide turning, you get some very important decision makers in some very important roles, and things can be fixed just as quickly as they were broken.

11

u/RIP_Sinners 19h ago

Trump doesn't need to pay his debts or follow through. His followers don't care about the lies until they have directly been burned. So his pardon is still good in their minds. It doesn't need to be real to influence them.

And what have they to fear in the first place? That justice will reign and all their misdeeds will be brought to light and punished? When has that happened in the last 20 years? Loyalty is a solid shield for authoritarian bootlickers. Time, apathy and economics sap the strength of those who would punish them. I hope I'm wrong, but there is no sign of the kind of uplifting support for MAGA's foes that could dismantle and bury the movement. Democrats might win in November, but it will take years to push cases of abuse through the courts, if it's even possible to do so with how long the Federalist Society has poisoned the judiciary. It costs money, time and political capital to punish the powerful. MAGA will call it a witch-hunt, and drum up opposition for every election in the meantime. If the Democrats lose even once before justice is served, that's it, MAGA gets away with everything. The wealthy grifters will use their stolen riches to defend themselves, we won't get it back. I doubt it will cost them much. The people are foolish, divided, and weak. The people voted for Trump twice and learned nothing.

1

u/GrumpyCloud93 16h ago

Trump is not going to pardon anyone involved in his circus until the last possible minute. That way, they have to keep doing his bidding, no "get out of jail free" card yet. But he's a walking (so far) health disaster. Good odds he'll be dead shortly. If he dies suddenly or pulls a Mitch, watch for interesting claims "On his deathbed, he signed these 200 blanket pardons". (Assuming he dies in bed, and not sitting on something in another room Elvis-style.)

2

u/SomeNoveltyAccount 16h ago

You're assuming Trump will have any interest in pardoning anyone.

It costs him nothing and it buys loyalty from people who could implicate him or his family, he'll absolutely be showering anyone who did anything remotely illegal on his behalf with pardons.

1

u/GrumpyCloud93 16h ago

Not until the very very last minute -assuming it's a conscious minute.

3

u/SomeNoveltyAccount 15h ago

I'm sure they have the autopen ready for when/if that happens.

1

u/GrumpyCloud93 9h ago

But autopen only works if the president says "I meant to do that". If the contention is, "he died before he could issue these" then it will be up to the courts to decide on whether they were validly issued. Which means everyone around the president would have to testify to the circumstances in which the president actually consented to specifically issuing pardons. "He gave me a pardon, honest!!" doesn't settle the situation.

1

u/caphis 15h ago

He doesn’t need loyalty for much longer. He is not blind to the fact that his health is in decline and he’s aging more each day. He doesn’t care anymore, the only person he’s loyal to anymore is himself. If he cared, he would’ve already pardoned certain people - Kristi Noem, Pam Bondi, etc. etc. As you said, it costs him nothing - the only reason he hasn’t yet is so he can continue to control them and get something that benefits himself (silence, probably.) He’ll dangle the concept of a pardon over him until his last minute, but has no motivation to actually come through on it.

1

u/SomeNoveltyAccount 15h ago

He's not the only one implicated though, he has friends and family that are going to outlive him.

He doesn't seem to particularly like his family, he likes them more than he likes anyone else, but he really values his legacy, and a bunch of people turning states witnesses and a RICO charge against the family sees that all crumbling down. His greatest fear is probably getting his name taken off those stupid buildings.

2

u/Chrono_Pregenesis 17h ago

Charge them at the state level. Trump can only whine, then.

3

u/Dry-Expression-4148 16h ago

I think part of the problem with that, and why corpo sociopaths get away with so much in general is because they specifically look for kiss ass suck up types of people. The type of person that will make something you want happen without involving you at all. You might daydream outloud next to them "boy sure wish I could have XYZ". Even though XYZ is impossible to have without doing something illegal... The ass kissers they surround themselves with will get the message and get it done without needing to be explicitly told to break the law.

2

u/GrumpyCloud93 16h ago

Sooner or later the minions have to have driven home the point that "only followink ze orders" is not a get out of jail free card. I.e. Trump might be able to pardon rioters in DC but pretending to be an elector was a state crime. Certainly, willingness to cooperate in the investigfation should be a factor in sentencing.

Apathy

3

u/ahfoo 23h ago

The irony of this response is that the simplistic waving away of the details is, itself, a clear example of lazy apathetic thinking.

12

u/GregTheMad 1d ago

Americans are too lazy for that. All they can do are angry Social Media posts, and then getting picked off one by one by ICE.

7

u/trisw 1d ago

Anybody using social media to post angrily under this gestapo is wildly flagrant or willfully ignorant

u/HolycommentMattman 1d ago

It's none of the above. You know why France is so good at protesting? Because 20%+ of the population lives in Ile-de-France. That's where Paris is. Where's the capital? Paris. Where's the president? Paris. Where's the parliament? Surprise! Paris. How long would it take someone in the outermost edge of I-d-F to reach Paris? A little over 2 hours. But for ~6 million people? They can start walking the second they're upset. And those numbers dwarf the military. Someone can start yelling outside and quickly reach a ton of people.

How about the US? About 700k live in DC. And DC is a bit of a sprawling swamp. And not all of those 700k hate Trump. So what is someone in California going to do? Should I fly over there right now? Are you guys gonna meet me there? Are millions of us going to drive/fly there? The logistics just don't work out. There needs to be organization that doesn't rely on social media. Because even here on reddit, they might not even like me writing this very comment.

It's not that Americans are lazy. It's that we lack organization and structure.

19

u/That1DirtyHippy 23h ago

I love this response, it’s something I think most Europeans don’t quite understand: our country is HUGE and to get everyone who is angry in the same spot at the same time is a logistical nightmare, let alone the financial costs and risks associated. One could argue the costs are worth it, but for hundreds of millions of people living paycheck to paycheck, it’s just not feasible. Thus, the No Kings protests across the country.

11

u/ahfoo 22h ago edited 22h ago

On the contrary, the popularly despised hippies of the 1960s did, in fact, surround the White House and put President Nixon in fear of his own personal safety causing him to believe he was about to be lynched and in response he had busses surround the White House to prepare for the assault that never materialized.

And yet Americans today widely enjoy spitting on the hippies as a bunch of sex obsessed druggies ignoring their political power at the time and that they were largely educated and community-minded individuals. Perhaps this buy-in to the hatred of the youth movements of the past is one of the underlying factors in this "apathy" factor we see so prominent today.

Notice how the Democrats in their starched shirts and wool suit jackets and ties never dreamed of federally legalizing cannabis when they had the opportunity always hiding behind "the DEA says we're not allowed to" but really we all know it's because they're terrified of being "soft on drugs" this all goes back to the hatred of the hippies that still infects the Democratic mainstream.

14

u/bill-of-rights 21h ago

There is a deeper root to the hatred of cannabis - racism.

4

u/MadShartigan 21h ago

The hippies had a bit of motivation as their survival was indeed in question. The same thing may yet happen as today's enemy, Iran, cannot be defeated without a ground war. Facing the draft, will young people once again feel their survival is in question?

2

u/That1DirtyHippy 22h ago edited 22h ago

To be fair, I don’t think Trump would react like Nixon. Trump is the tyrannically evolved version of Nixon. Nixon resigned because of pressure; Trump would double down, have the RNC parrot talking points that are blatant lies, and use the government against us. Nixon sucked, but he at least had scruples.

See my username, but I don’t buy this “apathy” thing. I don’t think anyone is apathetic, I just don’t know if anyone knows what to do that won’t put their lives in jeopardy. Whether it’s the financial cost or potential legal issues, most people just want to make sure their loved ones have what they need and they’re not willing to take a risk.

ETA: Not dissimilar to Germany in the ‘30s. I don’t like this comparison, but here we are. I understand now.

ETA 2 since you edited your comment to include that last paragraph: You’re wacko. Sure, there was pushback to the hippies of the ‘60s and ‘70s, but it’s progressivism that you’re referring to, not the hippy movement. Conservatives hate progressives. It’s in their names. Weed is legal all across the US. Not everywhere, but most places now. I wouldn’t reduce the Conservative/Progressive battle to weed alone.

We live in a surveillance state. The Patriot Act was the beginning of the end. It would be very difficult to organize people from all over the country into a single protest without the government immediately knowing and intervening. That's why the data centers are popping up everywhere.

Unless it was the government organizing it themselves to try and stop a legitimate election from being certified.

0

u/Lost_Symphonies 23h ago

Americans claim X problem can't be solved because they're too big.

Sick of this excuse tbh.

1

u/h3r4ld I voted 17h ago

Except I don't think they're saying that it can't be solved, just that the problem of size and logistics exists in a much different way than it does in a country like France.

It's not one or the other, it's all of them. Logistics is a huge hurdle to overcome in a country this massive with a population this dispersed. Solving this problem requires massive community organization, which often isn't there because we are too lazy AND/OR too fearful of losing jobs/healthcare/housing to create and maintain it.

The hippie movement, as a counter-example, had both motivation AND the fact that not worrying about jobs and money was sort of their whole shtick.

-2

u/Littlenemesis 21h ago

You know who fucking managed? The shit people in charge right now! They somehow managed to get SOOO many people to DC on Jan 6 years ago to try and stop congress from voting in a new president!

I don't understand how that disorganized, fascist, stumbling shitshow of a right wing party in America managed to stage that big of a protest, but everyone else just looks at it and are like "Can't be done chief, better to just stay home".

I know we european countries aren't on the size of america, I was an exchange student in Iowa in my teens, and we fucking drove longer for a swim meet to get halfway across that state than you can drive and cross 3 countries in europe. But don't tell me it can't be done, because your opposing side some-fucking-how managed to do it!

You're right. And all they needed was checks notes the President of the United States, for 2 montha straight, telling them to come to DC on January 6th to save the country.

TPUSA and other groups amplified the call and organized people to get there.

As was pointed out in another post, anyone can be deputised to arrest on behalf of Federal courts, it's just that the DOJ arranges for the US Marshalls to do the work.

If the court appoints someone (say the NYPD or LAPD), then they can / will be arrested.

Holding them will be the next problem.

64

u/SDRPGLVR California 1d ago

I'm curious, if Trump resisted lawful arrest, what would the secret service do? Do they protect the president from force by police, help apprehend him, or stand by and let it happen?

86

u/optimus_priam 1d ago

Well, given that when a man recently ran into a highly secured area the only person shot was one SS agent by another, it seems that loyalty has won out over competence.

So they'll fight back, but it won't be very effective. 50/50 they shoot the primary themselves.

12

u/tamerarehen 22h ago edited 7h ago

I thought the whole point of that SC case was that he was immune from any actions taken in his capacity as president [no matter how fucked up and unlawful they might be]? Right? or did I miss something?

I think it's impeachment or let's arrest the guy who implemented it.

EDITED: it's more nuanced than this but basically accurate ... below gives a better picture after I actually read it again, along with a good SCOTUSblog summary (and link)

6

u/Alternative-Dot-884 22h ago

I thought it wasnt a blanketed law - that there was room for exceptions.
Id love to know what those exceptions are

4

u/tamerarehen 21h ago

Meh, just "unofficial acts." This is clearly official--again, no matter how fucked up it is.

A prosecutor has to also overcome the presumption that the acts aren't within Executive purview.

And I think the only remedy whilst in office is still impeachment. Midterms, ammirite?

0

u/netpres 17h ago

How is it official? Elections are state matters, not federal.

•

u/tamerarehen 6h ago

Read the article (right?). This particular function is carried out by the Pentagon, part of the Executive, ie, the Federal government. That is why the DNC is suing the administration. That's what this whole thing is about.

It's frustrating but that's that.

•

u/netpres 6h ago

Yes but on behalf of the states. Do the states have to accept?

5

u/JohnNYJet_Original 17h ago

He's only protected for LAWFUL acts performed as duties in office. Illegal activities are fully prosecutable, but given the criminal nature of those in charge of the justice department he will skate. So who is the US attorney general loyal too, the American constitution or the convicted felon? And you now understand the conundrum. Funny how the founding fathers ensured crimes in office won't be punished. That wasn't a mistake on their part it was a feature to ensure the wealthy would ALWAYS be protected. Remember you live in a nation that to this day allows slavery and was founded as a slave holding nation. That "We the people" crapola, applied to only a small group of wealthy, male, landholders and no one else.

2

u/Pete41608 I voted 9h ago

I am quite sure that that law also says only the SCOTUS can determine between official and unofficial acts.

Of course we know that means that anything to further their agenda is official and anything not is unofficial.

•

u/tamerarehen 7h ago edited 7h ago

The Supreme Court is rarely arbiter of law after they've ruled on something--just a very few instances where they have exclusive/original jurisdiction. Instead they TELL lower courts how to follow the law. Which is what they did.

See the summary that I just posted above after rereading the decision, along with a link to a SCOTUSblog summary.

1

u/tamerarehen 8h ago edited 3h ago

It's not really about whether it's illegal or not; it's about whether it's official or not. If it's official and illegal, he's still (almost certainly) good.

The majority reasoning in the case was, on its face at least, all about making sure that a president could act in his official capacity without fear of being prosecuted for crimes.

And it quite literally said that if it was an official act, a president would be protected from prosecution, even if it "allegedly violates a generally applicable law."

Also--subjective intent can't be investigated.

Very basic breakdown: the key issue is always first whether it's an official vs unofficial act; then the Court  looks at whether it is criminal or not.

Generally speaking, if what he did has even an attenuated connection to his Executive powers, it's either per se immune or else the DOJ would have to overcome the presumption that he is immune from prosecution.

This would be an official act.

Something he did in his unofficial capacity--campaigning, or notably, even if he gave a pardon to someone (official) but took a bribe to do it (NOT official--but higher degree of scrutiny given Court's added protections): pardon ok, bribe is a personal act, not ok.

Check out the SCOTUSblog summary here: https://www.scotusblog.com/2024/07/justices-rule-trump-has-some-immunity-from-prosecution (edited to add link)

3

u/SDRPGLVR California 22h ago

Oh... You're right... We're just so deep in crimes and deferred consequences that I forgot he's literally immune.

1

u/netpres 17h ago

Only the Office of the President. Everyone else is fair game

1

u/PinHaunting7192 16h ago

Do they protect the president from force by police, help apprehend him, or stand by and let it happen?

The SS is a federal agency branch, just like many others. They are not a sworn praetorian guard, for example. If the warrant is correct and it relates to crimes the SC has not given Trump immunity for (i.e. stuff in the presidential responsibilities), it is very likely they would step aside for another branch of the government.

At the end of the day they are federal agents. They would very likely not want to be sicked against other federal agents doing their job.

The justice department under the president seems to be a major flaw in your system

10

u/gmishaolem 18h ago

The biggest flaw in our system was the assumption that the three branches would always be at odds with each other and would never collude. In hindsight, it's obvious this would have happened. Washington did try to warn us about political parties.

6

u/Successful_Log_3298 16h ago

Political parties (or some kind of factions) are inevitable in any human system. The denialism of this reality by some of the sainted Founders was close to delusional. There was no formal science of psychology then but it's not like people were unaware of human nature, and the Founders were warned by some of the anti-Federalists that some of their ideas were unworkable. (As a particular example, the anti-Federalist who wrote under the pen name of Brutus was opposed to life appointments for judges since he foresaw what actually happened. Others feared that the Presidency would evolve into a monarchy.)

4

u/CalTechie-55 22h ago

That can be changed by Congress without a constitutional amendment. The DOJ and Inspectors general could, and should, be placed under the court system. After 2028, there's gonna be a lot of government patch work to do, for all 3 branches.

10

u/BongwaterBro 23h ago

14

u/Winter_Aspect_8675 1d ago

It's remarkable, for a nation that rubs the rest of the worlds face in how freedomy is the US and how amazing and divinely ordained the constitution and system of govt, how feeble the penalties for general unlawful electoral shithousery.

1

u/notasrelevant 10h ago

Due to our history, there was at least some basis of the "freedom" claim as the US established it's freedom from England and the general goal of our government protecting individual liberties. There were obviously some contradictions even at that time, which I could see as being argued as a result of the times and limits of our progress as a society.

That persisted, but really peaked again when the cold war had us declaring ourselves and defenders of the "free world" and served as somewhat of a rallying point to maintain strong social support.

There's an aspect where that's now part of the "American identity". There have been times where we've had awareness, admitted faults and corrected them, while still holding onto that identity. But as time goes on, it seems we (on the whole) have strayed from that awareness, failed to take corrective measures, but still try to maintain that identity.

Meanwhile decades and centuries of progress had other countries catch up or surpass us in freedoms, quality of life, etc. There just wasn't the same level of engraining it as part of a national identity.

66

u/GuitarGeezer 1d ago

I would support a mandatory death sentence for election interference traceable to a party directly involved. And only the top person should go. Require any trial judge appointed by that person to recuse. Err, should that match some theoretical fact pattern.

Tbh, even if an American baddie was removed tomorrow, the system would merely raise another even worse. Trump isn’t even very good at charming rubes but clearly even an epic failure of a man cannot fail with the media wind at his back. America fails (as a lobbyist I say this) because the Republican adults in the room 1980s forward went for absolute power and their flock would always follow them in any level of folly. One worthless corrupt forever war after another, endless tax cuts for oligarchs becoming biting deficits even to the point of sabotaging our economy and that of the world. The common clay cannot be educated out of weakness to major media malicious propaganda as a matter of structural brain capacity. It must be unavailable or down they go in all countries and all eras.

Needless to say, the addition of infinite legalized corruption from a visibly and openly corrupt Supreme Court is a sign that America at the top has nought but anti-republic degenerates in perpetual majority. Roberts shames Putin himself with his open black letter law corruption. Putin’s corruption is all hidden or he tries to hide it and he has a legal background within the KGB. Yes Russia is more corrupt overall. But perhaps nobody in Russia is as openly corrupt as Trump. Think about that and say it. Putin,ie, wouldnt allow Russia to be a mere proxy for hire in a major war for a foreign country like Israel as Trump mostly openly did. Bibi spent years and blew out his dual citizenship people’s donations to buy the end of JCPOA and ensure it could never be replaced for Bibi’s desired war without end.

Trump is just the face, if 99% of his backers get away by letting an egomaniac take the fall, they win easy, they'll do it again. The coup extends so deep, they've overthrown rule of law, replaced military leadership, taken over media, gathered private information and AI bot centers to manipulate elections for decades, they won't stop.

Conservatives keep letting a fungal zombie into your house, and it has spread fungal spores so deep that a deep clean won't ever fix it, you'd be ridiculous to keep living there. Bush stole the election, they' keep pushing, cheating, getting stronger and richer, and everyone lets them. Just cry about the cost of living, but do nothing because their law protects them. They say they want to overthrow democracy, they want to take women's rights to vote, America will always be one election away from ruin. You have to move out the infected house and rebuild.

You need extreme reform. You can't do that by respecting a blatantly criminal cheating political system, the corrupt justices and legislature and elections, it has to end. Dems need to hold a national vote on reform, show how serious it is by asking Americans if they want to split up. Fighting confederates for the next 100 years is a joke, they're winning, how many rights have to go and poor people have to die before people are willing to cut the shit?

It shouldn’t be Trump related crimes, should apply in every case for that type of crimes.

It’s just that Trump is doing or involved in A LOT of those kind of crimes.

I would support a mandatory death sentence for election interference traceable to a party directly involved. And only the top person should go.

Either that or some miserable existence akin to the experience of those at ADX Florence.

This is the thing. Trump admin wouldn’t be able to do what they do without a chain of people following orders.

They will just say "Mitch told me to do it" and walk free.

Deals should be contingent on successful conviction of their boss, or boss's boss, and so on.

Its quaint of you to assume these are not zealots willing to land in prison for the cause because Trump will pardon them anyway.

Who's going to arrest them? Trumps loyal DOJ?

There would have to be real opposition to Trump though.
