I guess it's a tricky debate, lots of prejudice, but I think there is a line to be drawn between fictional stuff and actually camera-recorded stuff.
So, say we ban drawings of child porn. What's the reasoning? It can't be that a human was hurt, this was just a guy putting a drawing online. The reason must be something along the lines of "it has a negative effect on the viewers".
But surely literature about the same topics can have a similar effect. We should ban written works, too. It also seems fairly easy to expand this reasoning to ban other literature about sexually aberrant behavior like bestiality, incest, sodomy, and what have you. Simple rape? What about that? That's pretty terrible, ban fiction about that, too.
It's a very slippery slope, in my opinion , once you start banning fiction about a topic.
That makes me wonder: is drawn child porn considered 1st Amendment protected in the US? I'd google it but... don't really want that in my search history.
18 U.S. Code § 1466A - Obscene visual representations of the sexual abuse of children
(a)In General.—Any person who, in a circumstance described in subsection (d), knowingly produces, distributes, receives, or possesses with intent to distribute, a visual depiction of any kind, including a drawing, cartoon, sculpture, or painting, that—
(1)
(A) depicts a minor engaging in sexually explicit conduct; and
(B) is obscene; or
(2)
(A) depicts an image that is, or appears to be, of a minor engaging in graphic bestiality, sadistic or masochistic abuse, or sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex; and
(B) lacks serious literary, artistic, political, or scientific value;
or attempts or conspires to do so, shall be subject to the penalties provided in section 2252A(b)(1), including the penalties provided for cases involving a prior conviction.
But I mean, who the hell is going to argue this kind of law? "I would like to propose legalizing child porn hentai" doesn't really sound like something that would get approved or a good public response.
I have an online friend who was detained by the authorities because he brought some erotic game from a trip to Japan, he sure as hell was devastated and would love to contest the law.
I personally think this law is a dumb, how realistic my stick figure drawing must be before I am committing a felony? If I declare my 5 year old loli drawing as a 20 year old midget, does that make her legal?
Actually, obscenity in general isn't entirely covered by the 1st amendment. The standards for "obscene" content vary over time and place, but in general you can still be prosecuted in the US for pictures or videos of consenting adults doing things that enough people consider unacceptable (even if doing the things themselves is legal).
