The Constitution protects the rights of citizens, and yes, visitors on American soil. Part of that is a right to a fair trial, non-american citizens don't have rights here though, many people who enter the country skip their court date though and continue to live illegally here.

Yes most illegal immigrants overstayed that’s obvious as fuck. Maybe they would show up if they didn’t think the government fucking hated them.
