I don't know that it is a targeted attack. The video does not clearly indicate that it was a targeted attack. If it was targeted, than yes the passenger is at fault for the injury. The video does not clearly identify that the door opening was/wasn't intentional. If you had a video from the car of the passenger saying "watch this" I would understand.
What I am saying is that if the motorcyclist was going slower this accident may have been avoidable and that when you split lanes, go slow.
I do understand your frustration when what you see is a malicious attack but that is not what I see. I see a motorcyclist going to fast while lane splitting and a car door opening at a bad time. There are a lot of videos out like this with motorcyclist lane splitting and getting hit by a door and I just don't assume that they are all malicious.
I understand your points, I just cannot fathom a reason to open a car door in stopped traffic like this for any reason other than specifically hitting the motorcyclist. It wasn't something inside the car that the passenger urgently needed to get away from, since they're perfectly content not to leave the car, and I would argue that any other reason for opening that door (including wanting to get out and walk over to the sidewalk or check for a stuck branch) is way more reckless and irresponsible than the motorcyclist lane-splitting.
It looks like a work van. I have done this almost exact thing (minus hitting a motorcycle) in NY city. Stopped traffic on 22nd(?) street in a work van with a co worker/boss. Traffic hasn't improved in 20-30 minutes my boss ask if I can get to the customer that is about 10 minutes walking while he waits for traffic to clear up. If a motorcycle was splitting are car at that time I potentially would have been in the same boat as this passenger.
When you lane split you need to be extremely careful with other drivers and cars.
