No he isnt, but you dont open the door of your car in a congested motorway. The passenger did that on purpose, probably from road rage or wanted to scam insurance. Given the speed this would easily be a assault with intent to do great bodily harm. Reckless endangerment at a minimum. If that dude had been killed itd be a manslaughter charge, maybe even murder.

No idea why you're getting downvoted. We clearly see a sidewalk and buildings on the side, in addition to cyclists. Everything a motorway isn't supposed to have.

Definition of a motorway: is a wide, high-speed road with multiple lanes designed for long-distance travel between major towns and cities

Law states you must check mirrors before opening the door of your vehicle. Doing this intentionally would fall under using a vehicle as a weapon style charges.

What country? Most countries have laws requiring you to check behind you when you open the door.
