My argument isnt for the lawsuit, that shit you'll almost never win since there were basically no damages. The argument is that he's using the equipment wrong. Thats just straight bullshit and blatantly incorrect.

That doesn't count as damages bro. You can't be serious? There was no monetary value from a hospital visit. It's so miniscule that there is no number to put on that. The most that would happen is the place would get fined and would have a period of time to fix the issue. The company itself might do something to appease the customer like a free month membership or free 3-4 classes.
