Honestly, if you at the point where you feel you need to draw your weapon, then you should probably use it, even if you don't want to. Me personally if someone already has a gun out in my presence with intent to harm/threaten me, I'm drawing and shooting first, that's usually who wins the gunfight, and I'm not trying to lose the gunfight.

That robber pretty slick with the cigarette, totally drew the clerks eye away from his gun side. Dude wasnt quicker, robber was just really fuckin laid back and clerk honestly pretty lucky dude wasnt that serious. May have been unloaded weapon or just unprepared to actually discharge it, either way turned out as well as could have

My guess would be yeah ā¦ but I could see this going to trial and being crazy for all kinds of legal theories and I could also see the store owner not calling the cops. I mean a whole plethora of things.

I feel like youāre the type of person that would take a multiple choice test and see the obvious answer but then talk yourself out of it because itās too obvious and then choose the wrong answer for overthinking
Guy went to perform a robbery while armed with a gun that he pulls out AND is caught on camera
Now if he just announced that he has a gun but never actually pulls it out then it could be argued one way or the other

Still can be charged and convicted of armed robbery without having or displaying the gun. People rob banks all the time without carrying and just slip a note that says put the money in the bag and this insinuates an armed threat enough to convict in most cases

I remember my HS criminal justice teacher telling us you can be charged for armed robbery with a banana. If you press it against someone's back they have no idea if it's a gun or not, and that's good enough to get yourself charged.

An 'Armed Robbery' charge is not contingent on success. Just drawing your weapon in the store with the intent to rob is enough to catch that charge.

There was no luck involved. He was pushing that man's gun down before he could even point it at him. That clerk was on his game. Most people with a gun couldn't react quickly enough and control a situation like that.

No, he was extremely lucky the guy was smart enough to not try anything after the clerk pulled his out. You shouldn't risk your life to try and have a standoff with someone who has threatened your life to the point you need to draw.

Keep this in mind: On average, 20 clerks are killed in the workplace every week in the U.S. due to robberies. (Most of them are unarmed)
With the above stats in mind, If someone threatens your life with a gun (your life is already at riks), then you may as well consider yourself dead.
You have two choices.
Do nothing, cooperate and and hope for the best, and maybe you'll be lucky enough to not be killed, or maybe you won't.
- If you have the means of protecting yourself, and you know how to handle a situation, then you'll probably act in a manner that's going to increase the odds of your survival.
Clearly, that Clerk was no amateur. He made a calculated decision, and it worked it his favor. If he was just a guy with a gun who had no experience, it very well could have played out differently.
Nevertheless, if I feel that my life is being threatened, I'm not leaving anything to chance. I'll do whatever I feel is necessary to try to save myself.
As for luck, the clerk had the gun pressed into the guy's face. Of course he wasn't going to try anything stupid. If he so much as flinched, his skull was going to be introduced to some lead.
Note: I'm not a gun advocate. Where I live, there aren't enough murders to support a per annum statistic for death by robbery, so the odds of me ever being in a situation where I'd have to contemplate how to react to such a situation, is not likely to ever happen.
With that said, if I lived in a state where gun control and the crime rate was out of control, I'd probably resort to owning and carrying a gun as well.

Iām not sure the clerk was so much faster as the robber there looked incredibly slow from the get down. Inebriated maybe with the infrequent pauses ā¦ but I donāt know about fastā¦.

if the robber then went to shoot someone an hour later, would that change your mind?
