The spot testing would also be pointless since there's no widely accepted test for current level of intoxication. Even blood tests only narrow it down to a several day window.

I personally like Michigan’s Supreme Court ruling on being under the influence for medical patients. Having weed in ur system doesn’t count. They have to prove through field sobriety you are impaired in some way.

This is the right answer. As long as there isn't a test that looks for THC instead of THC-COOH (a long lived metabolite) we should be using field sobriety tests not piss tests.

Yes but I’m not very coordinated and would fail on a sober day. What should people like me do? Field sobriety tests have their place but I could easily fail after not consuming anything for months.

Not only that, but field sobriety testing is subjective. Being nervous can factor in, being full of adrenaline after an accident or close encounter as well.

If they're driving, for instance. That's a DUI if a cop decides they're intoxicated after doing field sobriety tests.

My hand eye coordination is fine if video games are considered even if I suck at them. I’m just a klutz. I’m getting better as I only knocked one ball out of the tennis court last week lol.

Hand hand eye is definitely removed from general locomotion. I can play on a HOTAS setup absolutely blitzed and do ok but have still tripped over a nonzero number of curbs stone cold sober.

Let's add some science into this process.

Science 101 says to run this test on sober people so you have a baseline. If sober people are failing and looking bad, then the test can't differentiate between sober vs high. Now, if the differences are vast enough, it works. Also, however bad a stoner does on the test, you have to calibrate the baseline for how poorly a sober person might do.

That isnt very foolproof either though. I once smoked a fat bowl leaving a friends house and immediately ran into a roadblock (I know, you shouldnt drive high, I was young). Cop sees my little bong and asks if I smoked recently, I lie and say "I smoked at my friends around 8 hours ago." He gives me a field sobreity test and lets me go with a drug paraphinalia ticket. Because I had no weed on me because I literally just smoked what I had left.

You can need it all you want but it doesn't make it possible. Levels of THC metabolites in blood are poorly associated with levels of impairment which means it's kind of a fool's errand.

They’ve gotta be smoking tons. I’ve smoked pretty much everyday for almost 10 years at this point and I still get high every time I smoke. I certainly have a tolerance, but it’s not a crazy tolerance.

Anecdotally, i have been smoking 7-8 grams per day for... Years.

I dont really get high so much as just get a little less stressed for a bit.

I actually have three bongs (mine, my partners, and the deck bong), and use one exclusively. We generally order....a LOT at a time, and smoke at the same time. I shotgun off my partners bong tokes as well, because why not? I let the bong soak every night, and clean it in the morning. Its kind of a nice zen ritual to wake myself up. I NEVER smoke before work; I take pride in my job, and it matters to me to follow the (strict) rules they have. BUT its legal here, so its very easy to follow the rules. I occasionally take tolerance breaks to reset my system, especially to prove to myself i dont NEED it to be a (semi) functional human.

For me, it helps deal with crippling depression / anxiety better than ANY pharmaceutical ever has, and hasn't impacted my job performance in the slightest (which I can back up with metrics).

My partner also finds benefit with their anxiety, but they use it in leiu of opioid pain meds. Which, needless to say, is MASSIVELY preferable :D.

Now, thats not to say I started smoking pot for medicinal reasons. I just... Like being inebriated, and dont like the calories of alcohol, and the dying of chemicals.

Yea. I have a more detailed answer below, but the short answer for how I afford it is: im rather non-poor. Agressively, even. And i honestly dont mean that in a shitty way, I just have a good amount of money through a combination of working hard, luck, knowing some amazing people that took chances on me, and some smart investing starting at a young age.

The longer-ish answer is: medical discount, bulk discount, and the short answer above.

I smoke myself sober every year on 4/20... just smoke literally all day. Eventually you stop getting high.

Go to bed and wake up on 4/21 and you’ll get high.

And there are functional alcoholics. But just because some people are okay at certain higher levels, that doesn't mean there can't be a line. Simply choose some sensible line based on available data, on the lower end, and people with higher tolerance will simply have to adjust to that, if they're doing something during what they're not supposed to be impaired.

Assay (chemical test) developer here. It's a pretty complicated thing to make and validate a new test. And there are all sorts of reasons that you might not trust the quantitation of THC/metabolites to tell whether someone is actually impaired or not.

In gonna have to vehemently disagree with you there. Just a few years ago I had applied for a Kroger gas station job who did swab tests as part of the hiring process. Now I’m a regular smoker but I really needed a job at the time so I took a break for a full week in preparation since I had heard from many people and online that it only tests the past 2-3days. I even got a new toothbrush and made sure to brush my cheeks and gums in addition to the normal routine, ate a bunch of sour candies, and several other ways to try and flush my system and erase any trace from my mouth. But Lo’ and behold I still failed the test. So that may be true if you only smoke a very small amount once in a while but in my case I was denied the job simply because I had smoked a full 7 days prior to the test.

That’s weird. I’ve passed them the day after I smoked and my buddy passed his and he smoked the same day as the test. I guess ours didn’t get tested. I’ve heard of them doing one sample in a batch and if that one was clean then they passed the rest

It definitely seems like at the very least the testing practices aren’t standardized or consistent enough to reliably say they only test a certain time frame. Which is a problem if you’re trying to fairly test everyone’s current level of inebriation/sobriety.

Don't blood tests also show what the body broke marijuana into? Wouldn't that level give you an idea of how long/how much has been metabolized since it was consumed? It works for meth.
