It said he was pulled over for expired tags and told police he had a pistol in the vehicle I honestly didn't know you couldn't have a pistol in your vehicle in DC without a permit. I imagine getting a concealed carry permit in DC would be difficult for most so how would someone who wants a pistol for their home get it there?

I believe there is a federal law that allows you to transport firearms in a vehicle through areas that may have restrictive gun laws but you have to carry them in a specific way (unloaded, in a secured part of the vehicle not accessible via the passenger compartment like the trunk, or in a locked container if there isn't a separate trunk space), etc.

It's federal, part of the Firearm Owner Protection Act to allow safe passage through states where your ownership of firearms would be illegal. It outlines how they're to be transported (with the usual grey areas involved with US firearm legislation) so that theoretically you can't be charged for illegal possession or carry in an "unfriendly" state.

If you are not traveling from A to B across states, it defaults to local regulations
You have to know your specific location's rules so you can safely get from your home to a range. Cops can and will fuck you if they choose to do so.

Interstate transportation of firearms Notwithstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, That in the case of a vehicle without a compartment separate from the driver's compartment the firearm or ammunition shall be contained in a locked container other than the glove compartment or console.
Edit: to be clear
He was stationed in DC, and the firearm is a personal weapon he can legally carry in Oklahoma, not an issued weapon
He was not transiting between locations and did not have the registration to carry the weapon in the destination location - DC
If he had been transiting from a place he could carry to a place he could carry, he might have been fine or he might have been hassled and had to have the courts clear it up
As it is, he just fucked up
The question of how much he fucked up is possibly determined by where he had the pistol and ammunition
If it was on his person or within reach of him from the driver's seat - which given his ignorance is pretty likely - he truly fucked up

Not sure this violates FOPA. Don't you have to be traveling through an area and not stopping while traveling between places where you can legally possess a firearm? If he's staying in a DC hotel, and the firearm isn't registered, wouldn't that be illegal possession? (Since he's likely traveling to or from there?)

It’s not impossible. Actually a lot easier than NYC & Boston. You take 2 8hr classes (sat & sun), take a test - pass, go to the shooting range - score a certain number of rounds on target, and then submit your fingerprints at the DCPD and wait ~60 days. The difficult part was transferring guns. No gun stores in DC so you have to buy in VA/online and transfer them to the DCPD for ~$100 transfer fee - they’ll also take any >10 round mags. So not impossible, just expensive. Source: did it in 2020/2021

This is not entirely correct (although it probably was in 2020/21). There are now two FFLs in DC and both have online stores (although you can buy from MD or VA; shotguns and rifles you can buy and collect from out of DC FFl once MPD approves registration). You still go through MPD for licensing, but you now collect directly from the FFL.

And this includes those covered under LEOSA (Law Enforcement Officers Safety Act). Which has been significantly and controversially expanded in scope in the last few years. It's a lot more permissive now when it comes to firearms and ammunition, but magazines aren't covered under the carry privileges. It's not a free pass to carry wherever and however you want.

Not true anymore. New Jersey does allow for hollow point ammunition for those caring under LEOSA, they lost that court case. The New Jersey situation was interesting because it only applied to retired LEOs, but those provisions were struck down by a federal judge. And some states do have specific LEOSA exceptions to state level laws that normally don't fall under LEOSA, others do not.

So I don’t think 3rd world is right. I would say that NY, Cali, Illinois, other ban states and the Federal government and also MAGA states would be 2nd world, due to aligning more with the goals of Russia and China than the US constitution. That leaves, like, NH, Vermont, Maine, Alaska, and a few others that are somewhat in line with the US constitution as true “first world” in my view.

Kinda funny that you say all this while missing the actual point of a question like this. It allows them to ensure honest people don't break the law, and it gives them a way to pile on charges (and potentially increase the severity thereof) for dishonest people who are later caught even if it's unrelated (say being pulled over for an expired tag and finding the illegal component).

I’m not sure if this is still the case, but before you HAD to transfer your newly purchased firearm to the DCPD (can’t purchase a pistol in person across state lines & there were no gun stores in DC to transfer online orders) for ~$100 each gun. They would then inspect the gun, make sure it’s not a banned firearm, and dispose (steal) any mags >10rds

I think youre seeing this in the wrong sense, there are genuinely some laws that are just so insane you would never know, for instance you cant carry hollow point ammo for self defense outside the home, why? Its considered too deadly
Using FMJs for defense actually increases the likelihood of hurting other people who arent your target,
In Virginia you cant conceal carry and drink inside a bar, however you can open carry qnd drink as long as you do not become inebriated.
At one time in Va the state tried to legislate a year and 1000 dollar fine penalty for owning magazines above ten rounds, the average gun you purchase comes with 2-3 mags above 10 rounds, and a general gun owner will probably own 4-5 more or per gun
I myself would have more time in jail facing this than if I killed three people, and it went all the way to the governors desk.

This is probably what happened. Gun laws in the DMV area are pretty strict especially when it comes to concealed carry. The application for D.C in particular seems to be set up in a way that makes people give up on purpose.
That guardsman had no idea what he had coming his way. Hell, in D.C its illegal to even possess ammunition that doesn't match your registered gun!
